CONDITIONS OF APPROVAL <br /> PA-1000065 <br /> Safeway, Inc. <br /> Site Approval Application No. PA-1000065 was approved by the San Joaquin County Community <br /> Development Department on July 16, 2010. The effective date of approval is July 26, 2010. This <br /> approval will expireďż˝.on January 25, 2012, which is 18 months from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with, (2) all necess_ary.`building permits <br /> have been secured and remain in force, and (3) all necessary permits from other agencies have <br /> been secured and remain in force. <br /> i, Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements. pertinent to this <br /> I application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Mo Hatef, [209]468-8477) <br /> F a. BUILDING PERMIT: Submit an"APPLICATION-COMMERCIAL BUILDING PERMIT.The Site Plan <br /> p required as d.lpart of the building permit must be prepared by a registered civil engineer or licensed <br /> architect. This Plan must show drainage, driveway access details including gates, on-site parking, <br /> landscaping,'-signs, existing and proposed utility services, and grading(refer to the"SITE PLAN <br /> CHECK LIST"for details). Foundation and soils investigation shall be conducted in conformance with <br /> Chapter 18 of.the California Building Code at the time of permit application. A fee is required for the <br /> Site Plan review. (Development Title Section 9-884) <br /> b. APPROVED'iPSE: This approval is for two wind turbine systems and the construction of two, 500- <br /> square-foot concrete foundations for the turbine and its equipment to be utilized for;electrical <br /> generation for an existing distribution center as shown on the Site Plan dated March 16, 2010. (Use <br /> Type: Utility 4ervices-Major) <br /> c. HEIGHT: Ttje two wind turbine systems shall be a maximum overall height of 299 feet each. (See <br /> Federal Aviation Administration letters dated June 24, 2010,Wind Turbine A and B). <br /> d. CAPITAL F4CILITY FEE: This project may be subject to the Capital Facility Fee. }If the Capital <br /> Facility Fee is;applicable, the County shall collect the fees before the issuance of any building <br /> permits. (Development Title Section 9-1245.2) <br /> ie. STORM DRAINAGE:Any additional stormwater drainage created by new improvements shall be <br /> retained on-site. The drainage pattern and corresponding storm drain improvements shall be shown <br /> i on the Site Plan. Drainage calculations prepared by a registered civil engineer or architect shall be <br /> included. (Development Title Section 9-1135) <br /> i f. SETBACKS;;"The structure shall comply with the following setback requirements: <br /> I, (1) The proposed tower and accompanying equipment shelter shall be set back a minimum of 30 <br /> .I feet fronj-,the front property line.
