Item No. 1 <br /> PC: 8-6-92 <br /> UP-88-19 (TE-92-19) <br /> Page 2 <br /> STAFF ANALYSIS <br /> BACKGROUND: <br /> The Planning Commission approved Use Permit No. UP-88-19 for the Bay Cities Truck Stop on November <br /> 29, 1990. The Safeway Distribution Center was also approved that evening and has been completed <br /> west of this site. On December 4, 1990,the Board of Supervisors approved Development Agreement No. <br /> DA-90-1. The Development Agreement applied to the Safeway site,the truck stop, and the area between <br /> those two sites. Since that time, Use Permits for the Costco distribution depot and the Foodmaker <br /> distribution warehouse have been approved. The first phase of the Costco project has been completed. <br /> Major Subdivision No. SU-92-2 for the Patterson Pass Business Park has been approved and has not yet <br /> been recorded. <br /> On July 1, 1992, the Board of Supervisors approved General Plan Map Amendment No. GP-92-2, Zone <br /> Reclassification No. ZR-92-2, and the first amendment to Development Agreement No. DA-90-1. The <br /> General Plan Amendment and Zone Reclassification provided for approximately 20 acres of Highway <br /> Service and 60 acres of Limited Industrial to the northwest of this site. The first amendment to the <br /> Development Agreement expanded the area covered by the agreement to include the aforementioned 80 <br /> acres. <br /> �`- POLICY CONSIDERATIONS: <br /> The Planning Commission is being asked to determine if significant changes have occurred since <br /> approval of the Truck Stop that would require the Planning Commission to deny the request for a Time <br /> Extension. Although there have been significant changes in circumstance, these changes have all been <br /> consistent with the approved Use Permit for the Bay Cities Truck Stop. <br /> Required roadways and provisions for water and sewage disposal are in place. Environmental Impact <br /> Mitigation Monitoring is in place, and regular reports of satisfatory progress are submitted by WESCO <br /> environmental consultants. <br /> If the Time Extension is approved, the previously adopted Conditions of Approval will remain in effect for <br /> the period of the Time Extension. <br /> ENVIRONMENTAL CONSIDERATIONS: <br /> An Environmental Impact Report was prepared for the original truck stop site, General Plan Amendment <br /> No. GP-84-16 and Zone Reclassification No. ZR-85-5, and was cert'fiied by the Planning Commission and <br /> the Board of Supervisors. A Supplemental Environmental Impact Report for the Bay Cities Truck Stop was <br /> certified by the Planning Commission on November 27, 1990. <br /> An Initial Study was prepared for the Time Extension on June 9, 1992, and no significant environmental <br /> impacts were identified. On the basis of that review, a Negative Declaration was prepared. In addition, <br /> a Certificate of Fee Exemption with a 'De Minimis Impact Finding' has been prepared which states that <br /> the Time Extension will not have an adverse effect on wildlife resources. <br />
