DEPARTMENT OF THE ARMY
U.S.ARMY ENGINEER DISTRICT,SACRAMENTO
CORPS OF ENGINEERS
1325 J STREET
SACRAMENTO CA 95814-2922
REPLY TO
ATTENTION OF March 15, 2011
Regulatory Division SPK-2009-01030
Mr. Rick Griffin
San Joaquin County Community Development Department
Development Services Division
1810 East Hazelton Avenue
Stockton, CA 95205
Dear Mr. Griffin:
We are responding to your February 25, 2011, request for comments on the Lone Tree
Creek Bridge Replacement project. The project is located in Section 4, Township 2 South, Range
9 East, Mount Diablo Meridian, Latitude 37.7974273°, Longitude -121.9966033°, Escalon, San
Joaquin County, California. We currently have a pending permit action under identification
number SPK-2009-01030 that identifies this proposed crossing among others.
The Corps of Engineers'jurisdiction within the study area is under the authority of Section
404 of the Clean Water Act for the discharge of dredged or fill material into waters of the United
States. Waters of the United States include, but are not limited to, rivers, perennial or
intermittent streams, lakes, ponds, wetlands, vernal pools, marshes, wet meadows, and seeps.
The Application Referral mentions Lone Tree Creek and the project map shows Lone Tree Creek
in the project area. Project features that result in the discharge of dredged or fill material into
waters of the United States, such as Lone Tree Creek, will require Department of the Army
authorization prior to starting work.
The range of alternatives considered for this project should include alternatives that avoid
impacts to waters of the United States. Every effort should be made to avoid project features
which require the discharge of dredged or fill material into waters of the United States. In the
event it can be clearly demonstrated there are no practicable alternatives to filling waters of the
United States, mitigation plans may be required to compensate for the unavoidable losses
resulting from project implementation.
Please refer to identification number SPK-2009-01030 in any correspondence concerning
this project. If you have any questions, please contact Julie Dickinson at 1325 J Street, Room
1480 Sacramento, California 95814-2292, via email Julie.E. Dickinsonl@usace.army.mil,
