Your letter was received in our
office on February 28, 2011.
The proposed project site is located northwest of the Town of Escalon in San Joaquin County,
California, approximately 0.23-mile southwest of the intersection of Lone Tree Road and Sexton
Road, at or around 37°49'28"N, 121002'1 0"W, at the railroad crossing of Lone Tree Creek.
The applicant, Burlington Northern & Santa Fe(BN&SF),proposes to replace a railroad bridge
over Lone Tree Creek. Our understanding of the project is that the entire bridge replacement
would be performed within the existing railroad right of way. This response is in accordance
with section 7 of the Endangered Species Act of 1973, as amended (16 U.S.C. 1531 et seq.; Act).
A review of the California Natural Diversity Database (CNDDB) for this site and other
information available to the Service reveals records for the federally-threatened California Tiger
Salamander(Ambystoma californiense), and the Valley Elderberry Longhorn Beetle
(Desmocerus californicus dimorphus), within a five-mile radius of your proposed project
location. In addition, the project occurs within potentially suitable habitat of the federally-
threatened Giant Garter Snake (Thamnophis gigas). Please be advised that the applicant will
need to contact the Service to consult on these species.
The Service recommends BN&SF's participation in the San Joaquin Multi-Species Conservation
Plan (SJMSCP), which would address species listed under both the Act and California Endangered
Species Act. Participation in the SJMSCP benefits the applicant in an expedited timeframe, while
TAKE P D ,
_ I
