Deed of Avigation and Hazard Easement <br /> The Community Development Department received a letter from the Kingdon Airport <br /> Manager. The letter, dated April 2, 2007, states that in order to protect the rights of the <br /> airports, the San Joaquin County Planning Department must enforce a "Deed of <br /> Avigation and Hazard Easement" that complies with the Airport Land Use Plan and is <br /> within the guidelines of the Federal Aviation Administration. However, Development <br /> Title Section 9-1610.8 states that avigation easements shall be required for new <br /> residential development projects, parks, schools, hospitals, group care facilities, and <br /> facilities providing child care in the areas (a) within the Stockton metropolitan Airport <br /> area of Influence; and (b) within the sixty-five (65) Db Ldn contour areas of all other <br /> publicly owned airports. <br /> As a result, the Community Development Department is confirming the requirement for <br /> the "Deed of Avigation and Hazard Easement' with the Airport Land Use Commission. <br /> Next Step <br /> When the applicant is ready to submit the full application, it will be necessary to do the <br /> following: <br /> • Submit the remaining portion of the Site Approval application fee. <br /> • Submit seven copies (18" x 26") and two reduced copies (8 112 " x 11") of the site <br /> plan depicting the above comments. <br /> • Submit seven copies of the application. <br /> • Submit proof that the nonconforming use has not ceased for more than twelve <br /> months (beyond County caused delays). <br /> Pre-Application Disclaimer <br /> NOTE: The pre-application conference is designed to inform prospective applicants of <br /> General Plan consistency, zoning consistency, public improvement requirements, <br /> preliminary design constraints and opportunities, and major environmental and safety <br /> issues.
