Analysis <br /> Background <br /> When the application was originally submitted, the gasoline pumps and mini-mart were located on the <br /> eastern portion of the site, adjacent to Sierra Drive. Five letters in opposition and several petitions <br /> containing a total of 119 signatures in opposition were received. The opponents were concemed that <br /> locating the mini-mart/gasoline sales on the comer of Sierra Drive and State Route 88 would create land <br /> use conflicts with residents of the Lockeford Bluffs subdivision. At the Development Committee meetir,t <br /> of January 22, 1998, the applicant was informed that the project was being referred to the Planning <br /> Commission for a public hearing based on the extent of controversy and that the Community <br /> Development Deparlment would be recommending denial based on the inability to make all of the <br /> required findings in the affirmative. Specifically, given the original project design, the rindings that the <br /> project would not be detrimental to the properties or improvements of adjacent properties (Finding No. 4) <br /> and that the use is compatible with adjoining land uses (Finding No. 5) could not be made. <br /> When this was discussed with the applicant at the Development Committee meeting, he agreed to <br /> redesign the project and incorporate all of the recommended changes. These changes included the <br /> following: <br /> 1. Reorient the proposed mini-mart and gasoline pumps to the western portion of the property; <br /> 2. Eliminate vehicular access off of Sierra Drive and extend solid masonry wall and landscaping in this <br /> area; and <br /> I Relocate access off of State Route 88 to include two driveways, one on each end of the property <br /> fronting on State Route 88. <br /> The applicant submitted revised application materials on April 20, 1998. New referrals were sent to <br /> agencies and surrounding property owners. No letters in opposition were received.
