FINDINGS FOR DEVIATION <br /> PA-1500248 <br /> 1. The granting of the Deviation will not be materially detrimental to other properties or <br /> land uses in the area. <br /> This finding can be made because the granting of the Deviation application will <br /> not be detrimental to other properties or land uses in the area. The use of the <br /> property will remain in agriculture and an agricultural storage building is a <br /> permitted use in the AU-20 zone. The change in the required front yard setback <br /> from a 55 feet from the centerline of Snyder Lane to 35 feet from the centerline <br /> of Snyder Lane will not change the look or character of the neighborhood or <br /> prevent the surrounding property owners from enjoying the full use of their <br /> property. <br /> 2. There are exceptional circumstances or conditions applicable to the property or to <br /> the intended uses that do not apply to other properties in the same zoning district in <br /> the vicinity. <br /> This finding can be made because the property is below zone minimum and is <br /> a corner lot, located at the corner of Snyder Lane and State Route 88, which <br /> results in increased setbacks and less buildable area on site. Snyder Lane has <br /> a width of 25 feet, therefore, setbacks are increased from 30 feet from the front <br /> property line to 55 feet from the centerline of the road, resulting in a 42.5 foot <br /> setback from the front property line along Snyder Lane. The majority of the <br /> property is planted in walnut trees, and also contains two existing single <br /> family residences, accessory buildings, and a power pole along the western <br /> portion of the property. Due to the property's location, increased setbacks, and <br /> existing structures, suitable building area is limited. <br /> 3. The strict application of the regulation deprives the property of privileges enjoyed by <br /> other properties in the vicinity. <br /> This finding can be made because the strict application deprives the property <br /> owner of the right to construct an agricultural storage building, which is a <br /> permitted use in the AU-20 zone. Development Title Section 9-824.2(a)(1) <br /> allows up to a forty percent reduction of the required front and side yard <br /> setbacks without a public hearing. <br /> 4. The granting of the Deviation is consistent with the General Plan. <br /> This finding can be made because the Deviation does not result in an increase <br /> in the General Plan density for General Agricultural properties nor does it <br /> change any intended use permitted in the zone. <br />
