Weber Avenue <br /> Stockton, CA 95202 <br /> AGREEMENT AND COVENANT <br /> This Agreement is made and entered into thiso&day of August, 2004, by and between <br /> SAN JOAQUIN COUNTY ("County"), and ROBERT KENT and JUDY KENT, husband and <br /> wife ("Kent") (Collectively "Parties"). It is made with respect to the facts and circumstances set <br /> forth in Section 1 of this Agreement. <br /> 1. Recitals. This Agreement is made with respect to the following facts and <br /> circumstances: <br /> A. Kent is the owner of a ten (10) acre parcel of real property located at <br /> 27300 N. Sowles Road, Galt, California commonly known as APN 007-120-05, <br /> hereinafter referred to as the "Kent Property". The Kent Property is more particularly <br /> described in Exhibit "A", attached hereto and incorporated herein by this reference. Kent <br /> applied for a variance from San Joaquin County(File Number PA-0400192)to reduce the <br /> zone minimum parcel size in the AG-40 zone from forty (40) acres to four (4) acres (the <br /> "Variance"). <br /> B. County approved the Variance at the hearing held on August 24, 2004 and <br /> specifically required that the approval would be subject to certain conditions and <br /> restrictions above general compliance with the San Joaquin County General Plan and <br /> Development Title. <br /> C. The Parties wish to enter into this Agreement to ensure the <br /> memorialization and recordation of the required conditions and restrictions and, in <br /> addition, to ensure that the conditions and restrictions will be effective through <br /> constructive notice to any purchaser of the Kent Property. <br /> NOW THEREFORE, it is agreed as follows: <br /> 2. Conditions and Restrictions. Upon execution and recordation of this Agreement, <br /> the Parties agree that the following are the conditions and restrictions attached to the Grant of <br /> Variance: <br /> 1 nf 4 <br />
