PA-0400192 OF ROBERT & JUDY <br /> KENT (APN: 007-120-05) (ADDRESS: 27300 N. SOWLES ROAD, <br /> GALT) <br /> The applicant has submitted the above referenced Variance application to change the <br /> minimum parcel size from forty (40) acres to four (4) acres in the AG-40 Zone to create <br /> two (2) parcels of four (4) or more acres each. <br /> The project site is located on the east side of Sowles Road, 900 feet north of Liberty <br /> Road, north of Lodi. <br /> The property has a General Plan designation of A/G (General Agriculture), and is zoned <br /> AG-40 (General Agriculture, 40-acre minimum). <br /> The application is scheduled to be heard by the Planning Commission on June 6, 2004. <br /> In order to approve the Variance, the Planning Commission is required to make three <br /> required findings. (Development Title Section 9-827.5) The Community Development <br /> Department has reviewed the proposed Variance application and will be recommending <br /> that it be denied based on the inability to make findings one and two in the affirmative. <br /> FINDINGS FOR VARIANCE <br /> Finding One: Special Circumstances <br /> Because of the special circumstances applicable to the property, including size, <br /> shape, topography, location, or surroundings, the strict application of the <br /> regulation deprives the property of privileges enjoyed by other property in the <br /> vicinity and under identical zoning classification. <br /> Applicant's Statement: "The variance should be granted because of the following <br /> special circumstances applicable to the property: <br /> I <br />
