<br /> 1. Contractor hereby agrees to furnish to customer sereices, equipment, and materials connected with the drilling of a water well on
<br /> the certain land situated in the county of S,
<br /> 2. This contract does not include any installation of a test pump for the purpose of developing a well,
<br /> 3. Itis expected that the well will be= o + a>z ~ _feet deep.
<br /> 4. The contractor:
<br /> A. Agrees to perform well drilling services under this contract in a workmanshiplike manner.
<br /> B. Agrees to keep a record of the strata passed through while drilling. Blank and perforated casing used.
<br /> C. It is understood by both parties that neither can tell just what will be found underneath the surface of the earth and that the work
<br /> of Contractor hereunder is subject to those conditions which he may find underneath the surface. Contractor shall not be liable
<br /> for any damages, direct or consequential, resulting from or connected with his inability to drill to the depth 'indicated in
<br /> Paragraph 3 above, his inability to discover or develop a suitable water supply, or his abandonment of drilling operations as a
<br /> result of encountering rocks, cobbles, solidified formations or other adverse underground conditions, nor does he represent or
<br /> warrant the sand content, quantity, quality or kind of water, if any, which may be discovered
<br /> D Contractor shalt not be liable for any consequertial damages, whether or not such damages are foreseeable at the time of this
<br /> contract. Including, but not limited to, lost profits or revenues, which may result from or be connected with the services to be
<br /> performed and materials to be furnished under this contract, including without limitation the condition of the well or the failure to
<br /> complete the well by any specified date for any reason.
<br /> E. Contractor agrees to utilize equipment in completion of the well which has the capability to drill to the depth specified.At no time
<br /> shall Contractor be required to drill deeper than the capability of the equipment assigned to the job or into rock, cobbles,
<br /> solidified formations, or other adverse underground conditions; upon his termination of drilling for such reason,Contractor shall
<br /> be paid for all services performed up to the point of termination according to the terms of this Contract.
<br /> 5. The bore hole drilling rate be subject to a per foot rock drilling surcharge, for each foot of borehole drilled in such formation.

<br /> 7. Contractor shall not be liable for any damages, resulting from mud, sand, rock, water, and debris taken out of any well during the
<br /> progress of the work,around and about the well at such places and in such manner as contractor may choose,and shall not require
<br /> contractor to remove the same.
<br /> 8. The contractor shall not be liable for any collapse or blockage in any well or for the deterioration in water quantity or quality after the
<br /> well's completion.
<br /> 9. The customer:
<br /> A. Hereby warrants that he has full right and authority to enter this contract and to authorize contractor to drill said well upon the
<br /> above described land.
<br /> B. Will provide, at no charge to contractor, storage of equipment and material which may be required under this contract.

<br /> and about the well at such places, and in such a manner as contractor may choose.
<br /> 10. "title to any material supplied by contractor will remain in contractor and will not pass to customer until the entire price called for
<br /> herein, or in any subsequent extra work contract, has been paid. Customer hereby grants to contractor a security interest therein
<br /> and acknowledges a mechanic's lien to secure payment of the amounts due under the terms of this contract. In the event of failure
<br /> or refusal of customer to pay as provided herein, contractor shall have the right to enter upon the above-described premises and
<br /> retake possession of such equipment and materials until payment is made in full. In any action to enforce the provisions of this con-
<br /> tract, the prevailing party'shall be entitled to recover costs and attorney's fees.
