CONDITIONS OF APPROVAL <br /> Unless otherwise specified, all Conditions of Approval and <br /> ordinance requirements shall be complied with prior to recording <br /> the Parcel Map. <br /> This approval will expire three (3) years from the date of <br /> approval unless (1) all Conditions of Approval have been complied <br /> with and (2 ) a Parcel Map has been filed with and accepted by the <br /> surveyor' s Division. <br /> Those conditions followed by a Section Number or other Statutory <br /> Requirement are based on Ordinance requirements. Ordinance <br /> requirements cannot be modified. <br /> 1 . COMMUNITY DEVELOPMENT DEPARTMENT: <br /> a. All numbered parcels shall have a minimum width of 150 <br /> feet. (Development Title Section 9-610 . 2) <br /> b. Parcels 1 through 4 shall be between 2 net acres and 5 <br /> gross acres in size. (Development Title Section <br /> 9-610 . 3 [a] ) <br /> C. The following note shall be placed on the Parcel Map <br /> and also recorded as a separate instrument: <br /> • In accordance with Section 9-610 . 3 of the San <br /> Joaquin County Development Title for the creation <br /> of homesite parcels, these parcels (including any <br /> remainder) cannot be further subdivided. <br /> d. Parallel to Bear Creek, a natural open space for <br /> riparian habitat and waterway protection shall be <br /> maintained to provide nesting and foraging habitat and <br /> the protection of waterway quality. The minimum width <br /> of said open space shall be 100 feet, measured from the <br /> mean high water level of the natural bank or 50 feet <br /> back from the existing riparian habitat, whichever is <br /> greater. Water-dependent uses may be permitted in this <br /> buffer. <br /> The mean high water level and the edge of the riparian <br /> habitat shall be shown on the Parcel Map. The open <br /> space buffer recuired above shall be shown on the <br /> Parcel Mat) with the following note: <br /> Pursuant to Section 9-1510 . 5 of the San Joaquin <br /> • County Development Title, this area is designated <br /> as a natural open space for riparian habitat and <br /> waterway protection. No development other than <br /> water dependent uses shall be permitted in this <br /> space. <br /> -1- <br />
