Appeal Statement No. 1 <br /> In his appeal, Mr. Bezley states: <br /> I would like to ask the Board to delete condition 1 d. It will stop me from dividing a parcel <br /> for my son in the future. <br /> Response to Appeal Statement <br /> A portion of Section 9-610.3(a)(1) of the Development Title states that only one homesite parcel may be <br /> created from an existing parcel and all homesite parcels created since July 29, 1992 shall be counted. <br /> Condition 1 d. gives constructive notice to future buyers that a homesite has already been created from <br /> this property, thus no further homesites shall be created. This provision does not prohibit the creation <br /> of one 80-acre parcel. <br /> Appeal Statement No. 2 <br /> In his appeal, Mr. Bezley states: <br /> It (condition 5 b.) will create a hardship and interfere with future planned aquatic farming. <br /> I believe Condition 5 a. protects the potential of any endangered species today or in the <br /> future. I have no problem with the waste disposal buffer. <br /> Response to Appeal Statement <br /> Condition 5a relates to the Endangered Species Act and other laws and regulations related to the <br /> Swainson's Hawk. It does not protect wetlands. <br /> In their letter of April 8, 1994, the Department of Fish and Game (DFG) notes that 'A project's aquatic <br /> ecosystem impacts should be mitigated by establishing a 100-foot no structural setback around the <br /> ponds.' The DFG has indicated that the applicant met with the DFG to discuss this condition. The DFG <br /> invited the applicant to suggest a revised condition that would protect the wetlands while allowing the <br /> applicant to proceed with his aquatic farming. As of June 22, 1994 the DFG has not received a response <br /> from the applicant. <br /> BOS LETTER PAGE 2 <br />
