PLANNING COMMISSION MINUTES <br /> FEBRUARY 17, 1993 <br /> 1. MINOR SUBDIVISION APPLICATION NO. MS-93-105 OF ERNEST BEZLEY <br /> (C/O MONTE SEIBEL) to subdivide a 236-acre parcel to create four 5- <br /> acre lots and a remainder of 216 acres. The project site is <br /> located on the south side of State Route 12 , one mile west of the <br /> Calaveras County line, east of Clements (Supervisorial District 4) . <br /> Continued from January 6 and February 3 , 1994 . <br /> Senior Civil Engineer Tom Gau said that the question before the <br /> Commission is whether or not this application can be considered as <br /> a major subdivision under the old ordinance. <br /> Comm. Rojas said that if this is to be a major subdivision, there <br /> should be a new application filed under the new ordinance provi- <br /> sion. <br /> Comm. Demichelis said that granting the applicant ' s request would <br /> open the door to other such requests. <br /> Comm. Zunino made a motion to deny the request to change the minor <br /> subdivision application to a major subdivision application. This <br /> motion died for lack of a second. <br /> Chair Carter asked if there was a new motion. Hearing no new <br /> motion, Chair Carter said that this application would be heard as <br /> a minor subdivision request. <br /> Associate Planner Chandler Martin introduced a staff report into <br /> the record. He said that staff could not make findings� 1 and 2 , <br /> but they could make finding 5 . Staff recommended denial of the <br /> application. <br /> PUBLIC HEARING OPENED <br /> PROPONENTS : Monte Seibel (223 Avena, Lodi) , representing the <br /> applicant, asked if he could appeal the decision not to allow this <br /> application to be heard as a major subdivision. <br /> Chief Deputy County Counsel Mike McGrew said the Commission did not <br /> make a decision on that request but that the matter can be <br /> appealed. <br /> Mr. Seibel asked for a continuance of this hearing for a few <br /> minutes until he could discuss this with his client. <br /> Chair Carter directed this item be continued until the Mr. Seibel <br /> has a discussion with his client. <br /> After his discussion, Ms. Seibel said that the decision has been <br /> made to appeal this application to the Board of Supervisors for the <br /> Board to determine if the application can be amended from a minor <br /> subdivision to a major subdivision. <br /> -24+- <br />
