CONDITIONS OF APPROVAL <br /> PA-1600024(MS) <br /> Nhon Tan Vien/Dustin Wilton <br /> Minor Subdivision Application no. PA-1600024 (MS) was approved by the San Joaquin County <br /> Planning Commission on August 4, 2016. The effective date of approval is August 14, 2016.This <br /> approval will expire on August 14, 2019, which is three years from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has been filed <br /> with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. Ordinance requirements cannot be <br /> modified and other ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Mo Hatef[209]468-8477) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated February 1, 2016. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br /> be placed on the Parcel Map and recorded as a Notice of Minor Subdivision Restriction: <br /> 1) All persons purchasing parcels within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural <br /> operations or activities, such as noise, odors, insects, dust or fumes. San Joaquin <br /> County has determined that such inconveniencies or discomforts shall not be <br /> considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH:The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 and 2 each shall have a minimum lot width of 150 feet. (Development Title Section <br /> 9-610.4) <br /> (2) Parcel 1 and 2 each shall be between two(2) gross acres and five(5)gross acres in <br /> size. (Development Title Section 9-610.3[a]) <br /> d. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of <br /> Minor Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a <br /> reference to the instrument number of said recorded notice, stating that: <br /> 1) The homesite shall not be transferred until August 14, 2026 or upon the death of an owner <br /> owning at least fifty (50) percent interest in the homesite parcel, unless the homesite parcel and <br /> the remainder parcel are merged pursuant to the provisions of the Development Title. <br /> 2) The property shown on the Parcel Map is restricted from further subdivision for homesite <br /> purposes, except for financing only, by Section 9-610.3 of the San Joaquin County Development <br /> Title. <br /> e. BUILDING PERMIT: The owner shall obtain a building permit for a single family dwelling for each <br /> homesite parcel concurrently with the approval of the parcel map.
