R5-2005-0512, DOLE FRESH <br /> VEGETABLES INC. AND WILD ROSE VINEYARDS LLC, FORMER VICTOR FRUIT <br /> FACILITY, SAN JOA QUIN COUNTY <br /> Enclosed is Administrative Civil Liability(ACL) Complaint No. R5-2005-0512 issued by the <br /> Executive Officer of the Central Valley Regional Water Quality Control Board (Regional Board)to <br /> Dole Fresh Vegetables, Inc. and Wild Rose Vineyards LLC (hereafter referred to as "Dischargers") <br /> for violation of Cleanup and Abatement Order(CAO)No. R5-2004-0714. The Complaint alleges <br /> that the Dischargers violated the CAO by failing to close wastewater ponds by 1 November 2004. <br /> This ACL Complaint names both Dole Fresh Vegetables Inc. and Wild Rose Vineyards LLC and <br /> proposes that the Dischargers pay$40,000.00 in administrative civil liability. <br /> Pursuant to the California Water Code, the Dischargers may either choose to pay the civil liability <br /> and waive a Regional Board hearing on the matter or to proceed to a hearing before the Regional <br /> Board on the Complaint. If the Discharger chooses to waive the right to a hearing, then a duly <br /> authorized person must sign the waiver and remit both the waiver and a$40,000.00 check, made out <br /> to the State Water Resources Control Board Waste Discharge Permit Fund, to this office by <br /> 27 May 2005. The resulting settlement of this ACL Complaint will not become final until after a <br /> 30-day public comment period which began on the date of the Complaint. Additionally, the <br /> Executive Officer may decide to schedule the complaint for a hearing consistent with California <br /> Water Code Section 13323(b). <br /> If you choose not to pay the civil liability, a hearing on this matter will be scheduled for <br /> 23/24 June 2005 in accordance with Section 13323 of the California Water Code.
