Sidof Caldomia•Nalural Resources Agency Edmund G Brown Jr.,Gwerrror
error
pepartrnert of Conservation
John M.Lowde,Assistant Director
Division of Land Resource Protection
801 K Street-MS 18-01
Sacramerto,CA 95814
(916)324-0850.FAX(916)327-3430
July 10, 2015
VIA EMAIL: MHATEF@SJGOV.GOV
Ms. Mo Hatef
San Joaquin County Community Development Department
1810 East Hazelton Avenue
Stockton, CA 95205
Dear Ms. Mo Hatef:
REVISED COMMENT: SEQUENTIAL PARCEL LOT LINE ADJUSTMENTS ON
PROPERTY UNDER CONSERVATION CONTRACT; APPLICATIONS PA-1500106
(LA), PA-1500108 (LA), AND PA-15001.09 (LA)
The Department of Conservation's (Department) Division of Land Resource Protection (Division)
has reviewed the lot line adjustment (LLA) applications submitted by San Joaquin County. The
Division monitors farmland conversion on a statewide basis and administers the California Land
Conservation (Williamson) Act and other agricultural land conservation programs. We offer the
following revised comments to our original letter date July 6, 2015.
Proiect Description
The proposed lot line adjustments were submitted as three separate applications, for a combined
total of seven adjusted parcel boundaries'. The lot line adjustments will occur on properties-under
a Williamson Act contract. The adjustments will create multiples homesite parcels within the
agricultural zone, that will no longer be subject to the contract, as well as a number of parcels less
than the 40 acre minimum zoning.
Department Comments
Because of the limited information provided in the application referrals, the Department requests
that the findings required in Government Code (GC) § 51527 of the Land Conservation Act be
addressed in the staff report(s). The proposed LLAs contain several areas of existing Williamson
Act contracted land that will be reconfigured and reclassified as non-contracted land. In doing so,
it is recommended that special attention be paid to GC § 51257(a)(2)-(4), and (7), which address
specific requirements that these types of modifications must meet. The staff report(s) should
evaluate the applications under GC § 51257 in terms of their overall impact, given that multiple
nonconforming parcels, including homesite parcels, will result from the chain of adjustments.
Finally, the Department recommends that the current contract be rescinded and simultaneously
entered into new contract pursuant to GC § 51527.
Thank you for giving us the opportunity to comment on the proposed lot line adjustment
applications. Please provide this Department with notices of any future hearing dates as well as
any staff reports pertaining to this project. If you have any questions regarding our comments,
Assessor Parcel Numbers: 055-070-13,055-070-26, 055-070-38, 055-150-07, 055-150-20,055-150-23,
and 055-140-12.
