%we <br /> M <br /> CONDITIONS OF APPROVAL <br /> PA-0700316 <br /> Grupe <br /> Minor Subdivision Application No. PA-0700316 was approved by the San Joaquin County <br /> Community Development Department on August 28, 2007. The effective date of approval is <br /> September 7, 2007. This tentative map approval will expire on September 6, 2010, which is three <br /> years from the effective date of approval, unless (1) all Conditions of Approval have been complied <br /> with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified,and other Ordinance requirements may apply. <br /> I. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Kevin Swanson 468-9653) <br /> a. TENTATIVE MAP: The parcel map shall substantially conform with the approved tentative map <br /> dated June 28, 2007. <br /> b. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 (Homesite Parcel)shall not contain less than two (2) acres or more than five(5)acres in <br /> size (Development Title Section 9-610.3). <br /> (2) Parcel 1 (Homesite Parcel)shall have a minimum lot width of 150 feet. (Development Title <br /> Section 9-610.4) <br /> (3) Parcels 2, 3, and 4 shall have a minimum lot width of 330 feet. (Development Title Section 9- <br /> 610.2) <br /> (4) Parcels 2, 3, and 4 shall have a minimum lot area of 40 acres in size (Development Title Section <br /> 9-610.2). <br /> (5) NOTICE OF NON-RENEWAL: A Notice of Non-renewal for parcel 1 will be required in <br /> conjunction with the contract. A fee for the recording of the Notice of Non-renewal is required. <br /> (6) TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to <br /> the instrument number of said recorded notice, stating that: <br /> A. The homesite shall not be transferred until September 7, 2017, or upon the death of <br /> an owner owning at least fifty(50) percent interest in the homesite parcel, unless the <br /> homesite parcel and the remainder parcel are merged pursuant to the provisions of <br /> the Development Title. <br /> B. The property shown on the Parcel Map is restricted from further subdivisions for <br /> homesite purposes, except for financing only, by Section 9-610.3 of the San <br /> Joaquin County Development Title. <br /> Conditions of Approval - 1 - PA-0700316 <br />
