i <br /> r +� <br /> Y <br /> CONDITIONS OF APPROVAL <br /> PA-0800194 <br /> Skobrak <br /> Minor Subdivision Application No. PA-0800194 was approved by the San Joaquin County <br /> Community Development Department on September 15, 2008. The effective date of approval is <br /> September 25, 2008. This tentative map approval will expire on September 25, 2011, which is three <br /> years from the effective date of approval, unless (1) all Conditions of Approval have been complied <br /> with and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jason Jones, 209-468-3136) <br /> a. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated June 28, 2008. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be placed on the Parcel Map and recorded as a separate instrument: <br /> (1) All persons purchasing parcels within the boundaries of this approved map should be prepared <br /> to accept the inconveniences or discomforts associated with agricultural operations or activities, <br /> such as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply to this map: <br /> (1) Parcel 1 shall be between two (2) net acres and five (5) gross acres in size. (Development Title <br /> Section 9-610.3[aj) <br /> (2) Parcel 1 shall have a minimum lot width of 150 feet. (Development Title Section 9-610.4) <br /> d. TRANSFER RESTRICTION: A Note shall be placed on the Parcel Map and a Notice of Minor <br /> Subdivision Restriction shall be recorded concurrently with the Parcel Map, with a reference to the <br /> instrument number of said recorded notice, stating that: <br /> (1) The homesite shall not be transferred until September 25, 2018, or upon the death of an owner <br /> owning at least fifty (50) percent interest in the homesite parcel, unless the homesite parcel and <br /> the remainder parcel are merged pursuant to the provisions of the Development Title. <br /> (2) The property shown on the Parcel Map is restricted from further subdivisions for homesite <br /> purposes, except for financing only, by Section 9-610.3 of the San Joaquin County Development <br /> Title. <br /> e. BUILDING PERMIT: The owner shall obtain a building permit for a single family dwelling for each <br /> homesite parcel concurrently with the approval of the parcel map. (Development Title Section 9- <br /> 610,3[a][4]) Foundation and soils investigation shall be conducted in conformance with Chapter 18 of <br /> the California Building Code at the time of permit application. <br /> Conditions of Approval - 1 - PA-0800194 <br />
