r r 2. REVISIONS OF APPROVE12 ACTIONS FOR USE PERMIT NO. PA-0800266 OF KENT RAVERTY CIO BAUMBACH&PIAZZA to revise Community Development Department Conditions of Approval 1.b, and 1.c(2)to increase the maximum number of people per marketing event from 150 to 370 people, to revise Condition 1.r.to modify the Saturday and Sunday hours of operation from 10.00 a.m.--6:00 p.m.to Friday, Saturday, and Sunday hours of operation from 9:00 a.m.—8:00 p.m., and to remove"by appointment only." The previously approved Use Permit is for the conversion of two agricultural buildings that total 10,880 square feet into an off-site wine cellar and wine tasting room and a banquet facility for up to 24 marketing events per year for a maximum of 150 people per event as shown in the Marketing Plan and on the Site Plan dated September26,2008 (Use Type: Wineries and Wine Cellars —Off-Site Wine Cellar). The project site is located on the southwest comer of Bender Road and Taddei Road, northwest of Lodi(Supervisorial District 4). Rick Griffin, Senior Planner, introduced the staff report into the record. PUBLIC HEARING OPENED: PROPONENTS: Mike Hakeem, representing the applicant, said they started with 150 people but then wanted 370 people, so they had a traffic study done. They have complied with the ordinance. This is not a bed and breakfast project. They do not serve lunch. They do not have a boutique. They have not violated the Williamson Act contract. They comply with the ordinance. There are 16 acres of orchards and one acre of crops. OPPONENTS: Matthew Perman said the site is zoned for agriculture. He has concems about 370 people coming into that cul-de-sac. No 40-foot truck will make the tum on Bender Road. He has concerns about dust, people working at night,traffic congestion, and odors from farming operations. Jack Hamm viceresident of the Farm Bureau said p , s d this use is not compatible with the agriculture zone. The County roads cannot handle that kind of traffic. Katie Patterson, representing the Farm Bureau, said this project is not agri-tourism. REBUTTAL: Mike Hakeem said they are allowed to have weddings. They are not serving lunches. They do not have a restaurant. No agricultural ground will be used for parking. The buildings are already existing. PUBLIC HEARING CLOSED: Commissioner Villapudua said he has no problem with the project. Commissoiner Morri said he can make the findings. Commissioner Johnson said he does not think this project will have a negative impact on farming in the area. He is in favor of the project.
