3. WILLIAMSON ACT CONTRACT CANCELLATION NO.PA-0900263 AND SITE APPROVAL NO.PA 09002"OF KENT RAVERTY: The first project is a Williamson Act Contract Cancellation application to cancel a 1.2-acre portion of a parcel that consists of 22.6 acres.The 1.2-acre area contains a 9,998-square-foot single family residence, a large driveway, and a swimming pool. There are no agricultural uses on the 1.2 acres. The approval of the Williamson Act Contract Cancellation application is a prerequisite to the approval of the accompanying Site Approval application. The Site Approval application is to convert the existing residence into a bed and breakfast inn (Use Type: Lodging Services-Bed and Breakfast). The project site is located on southwest comer of Taddei Road and Bender Road,Acampo (Supervisorial District 4). Rick Griffin,Senior Planner,introduced the staff report into the record. PUBLIC HEARING OPENED: PROPONENTS: Make Hakeem, representing the applicant, said the building is already on the site. They decided to cancel one acre of the Williamson Act to allow a bed and breakfast facility. The Department of Conservation has agreed with the findings. OPPONENTS: , Katie Patterson, representing the Fara Bureau, expressed concerns about how agriculture is not benefited by this project. Public interest findings cannot be made. The nonrenewal process for the Williamson Act was not followed. This project should be brought back to the Department of Conservation. Finding 2 offers no analysis about the effect on the adjacent properties with the Williamson Act nonrenewal. The existing home is within the riparian zone. There should be a habitat plan for that area. The whole site should be put up for nonrenewal, not just the one acre. REBUTTAL: Mike Hakeem said there will not be any weddings in the bed and breakfast facility. PUBLIC HEARING CLOSED: Commissioner Johnson said he is ready to make a motion. Commissioner Mom said the bed and breakfast will bring in people from other areas. - Commissoiner Nickerson said this project will benefit the wine industry. MOTION: It was moved,seconded(JohnsonArilapadua), and passed by a unanimous roil call vote(4-0)to: 1. Approve the Negative Declaration; 2. Forward Williamson Act Contract Cancellation Application No. PA-0900263 to the Board of Supervisors with a recommendation of approval,with the Conditions and Contingencies contained in the staff report, based on the ability to make the required Findings for Williamson Act Contract Cancellation.
