Deny Minor Subdivision Application No. MS-92-48 due to the inability to make Finding No.
1.
FINDINGS
1. The proposed map is consistent with applicable General and Specific Plans.
• This Finding cannot be made because the application does not meet the intent of the
retirement homesite provision of the Planning Title, and the existing home is not the
applicant's residence.
2. The design or improvement of the proposed subdivision is consistent with applicable General and
Specific Plans.
• This Finding can be made because the proposed parcel meets all County
development and design standards, and no Specific Plans apply to this site.
3. The site is physically suitable for the type of development.
• This Finding can be made because the proposed two-acre site is level and meets all
the minimum County requirements.
4. The site is physically suitable for the proposed density of development.
• This Finding can be made because the proposal meets the density requirements of
the Agriculture General Plan designation.
5. The design of the subdivision or the proposed improvements are not likely to cause, substantial
environmental damage or substantially and avoidably injure fish or wildlife or their habitat.
• This Finding can be made because the Initial Study prepared for this project did not
identify any rare or endangered species or habitats or other substantial,
environmentally adverse effects.
g. The design of the subdivision or the type of improvements is not likely to cause serious public
health problems.
• This Finding can be made because the conditions attached to this project by the
Department of Public Health Services will address any potential public health
problems.
