Thornton Rd. , Lodi, CA <br /> Dear Mr. Borges : <br /> This letter is written on behalf of my clients, Raymond and <br /> Barbara Coldani . Mr. and Mrs. Coldani own real property located <br /> West of I-5 in the vicinity of Highway 12 and Thornton Road. The <br /> real property owned by the my clients is currently leased to Helen <br /> Lima, Patricia Hamm and Jack Hamm, individually and doing business <br /> as LIMA RANCH. <br /> It has come to the Coldani ' s attention that Lima Ranch either <br /> has applied for or is in the process of applying for a permit to <br /> increase the size of their dairy by increasing the number of cows . <br /> It is my understanding that in order to increase the number of <br /> cows, Lima Ranch must have sufficient acreage available upon which <br /> to discharge the manure and waste from the dairy. The Coldani ' s <br /> are informed that Lima Ranch has included the property they lease <br /> from the Coldani ' s to meet the acreage requirement for the <br /> discharge of the manure and waste. <br /> This is to inform you that the lease agreement between the <br /> Coldani ' s and Lima Ranch has a specific provision restricting the <br /> use of the lease premises to "growing dairy feed crops only" and no <br /> other use . The Coldani ' s have not consented to a modification of <br /> the lease to allow for the discharge of manure on the premises and <br /> they consider the use of the lease premises for manure discharge as <br /> a violation of the lease provisions and a breach of the lease. <br /> The Coldani ' s have notified Lima Ranch of this position and <br /> informed them that they will consider any use of the property for <br /> the discharge of manure or dairy wastes as a breach of the lease. <br />
