CONDITIONS OF APPROVAL <br /> PA-1000131 <br /> HIGHWAY 12 INVESTORS LLC ETAL <br /> Use Permit Application No. PA-1000131 was approved by the San Joaquin Board of <br /> Supervisor's on February 12, 2013. The effective date of approval is February 12, 2013. This <br /> approval will expire on August 12, 2014,which is 18 months from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with, (2)all necessary <br /> building permits have been secured and remain in force, and (3) all necessary permits from <br /> other agencies have been secured and remain in force. <br /> 1) COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Rick Griffin, [209]468-3154) <br /> a) BUILDING PERMIT: Submit an "APPLICATION-COMMERCIAL BUILDING PERMIT". The <br /> Site Plan required as a part of the building permit must be prepared by a registered civil <br /> engineer or licensed architect. This Plan must show drainage, driveway access details <br /> including gates, on-site parking, landscaping, signs, existing and proposed utility services, <br /> and grading (refer to the "SITE PLAN CHECK LIST" for details). Foundation and soils <br /> investigation shall be conducted in conformance with Chapter 18 of the California Building <br /> Code at the time of permit application. A fee is required for the Site Plan review. <br /> (Development Title Section 9-884) <br /> b) APPROVED USE: This approval is for a Use Permit for the construction of a truck stop on <br /> 11.68 acres as shown on the Site Plan dated March 25, 2011 (Use Type: Truck Sales and <br /> Services-Stops, and Eating Establishments-Convenience and Full Service). The project <br /> includes 16 pumps and 24 fueling stations to serve 16 gasoline and 8 diesel fueling <br /> positions. The project also includes a 7,700 square foot convenience store with an attached <br /> 3,000 square foot fast food restaurant, and a 1,200 square foot storage building. <br /> c) CAPITAL FACILITY FEE: This project may be subject to the Capital Facility Fee- If the <br /> Capital Facility Fee is applicable, the County shall collect the fees before the issuance of any <br /> building permits. (Development Title Section 9-1245.2) <br /> d) MONITORING PROGRAM: This project shall comply with the attached Mitigation <br /> Monitoring Program (Attachment A). <br /> e) AGRICULTURAL MITIGATION: Agricultural mitigation shall be approved before a building <br /> permit is issued (Development Title Section 9-1080). <br /> f) PARKING: Off-street parking shall be provided and comply with the following: <br /> (1) All parking spaces, driveways, and maneuvering areas shall be surfaced and <br /> permanently maintained with base material of appropriate depth and asphalt concrete or <br /> Portland cement concrete to provide a durable, dust free surface. Bumper guards shall <br /> be provided when necessary to protect adjacent structures or properties. (Development <br /> Title Section 9-1015.51e]) <br /> (2) (2) A minimum of sixty-seven (67) parking spaces shall be provided, including three (3) <br /> accessible spaces, one of which shall be van accessible. Accessible spaces shall be <br /> located as close as possible to the primary entrance (C.C.R., Title 24). (4 spaces are <br /> required for every 1,000 feet of building area. 0.67 spaces are required for every <br /> employee.) (Development Title Section 9-1015.3) <br />
