the landowner's considered judgment regarding how to develop its property in light of the <br /> realities of the marketplace. The Planning Commission believes it is appropriate to give some <br /> weight to this judgment. (See Laurel Hills, supra, 83 Cal.App.3d at p. 521 (a "public agency <br /> may approve a developer's choice of a project once its significant adverse effects have been <br /> reduced to an acceptable level—that is,all avoidable damage has been eliminated and that which <br /> remains is otherwise acceptable").) <br /> IX. <br /> STATEMENT OF OVERRIDING CONSIDERATIONS <br /> As set forth in the preceding sections,the County's approval of the Love's Travel Stops Project <br /> will result in significant adverse environmental effects that cannot be avoided even with the <br /> adoption of all feasible mitigation measures; and there are no feasible Project alternatives that <br /> would mitigate or substantially lessen the impacts. Despite the occurrence of these effects, <br /> however, the Planning Commission, in accordance with CEQA Guidelines Section 15093, <br /> chooses to approve the Project because,in its view,the economic, social, and other benefits that <br /> the Project will produce will render the significant effects acceptable. <br /> A. SIGNIFICANT AND UNAVOIDABLE IMPACTS <br /> The Love's Travel Stops Project will result in the following significant and unavoidable impacts: <br /> Impact 5.2 Freeway ramp junction operations,EPAP Plus Project conditions.Under <br /> existing conditions,the I-5 SB Merge from SR 12 and I-5 SB Diverge from SR 12 ramp <br /> junctions would operate at an unacceptable LOS D during a.m. peak hours,while the I-5 <br /> NB Diverge from SR 12 ramp junction would operate at an unacceptable LOS D during <br /> p.m. peak hours. Project traffic would increase the density at these ramp junctions that <br /> already experience unacceptable LOS,which is considered a significant impact.Although <br /> widening the subject ramps to include an additional lane would alleviate the substandard <br /> ` operating conditions,both without and with the Project,it is uncertain that these types of <br /> V interchange modifications would be implemented, since no transportation plan currently <br /> includes such improvements. Therefore, the County considers such mitigation to be <br /> infeasible, and this impact is considered significant and unavoidable. <br /> Impact 6.3 Freeway ramp junction operations, Cumulative Plus Project conditions. <br /> Under Cumulative(2025)No Project Conditions, the I-5 SB Merge from SR 12 and I-5 <br /> SB Diverge from SR 12 ramp junctions would operate at an unacceptable LOS D during <br /> a.m.peak hours,while the I-5 NB Diverge from SR 12 ramp junction would operate at an <br /> unacceptable LOS D during p.m.peak hours. Project traffic would increase the density at <br /> these ramp junctions that already experience unacceptable LOS, which is considered a <br /> significant impact. Although widening the subject ramps to include an additional lane <br /> would alleviate the substandard operating conditions,both without and with the Project,it <br /> is uncertain that these types of interchange modifications would be implemented, since <br /> no transportation plan currently includes such improvements.
