PA-1000131 (LOVE'S TRAVEL CENTER) / <br /> (4 DISTRICT) /53os At. 71,r <br /> RECOMMENDATION: <br /> It is recommended that the Board of Supervisors approve the request to pay the in-lieu fee <br /> to fulfill the requirement for agricultural mitigation for Use Permit application No. PA- <br /> 1000131. <br /> BACKGROUND: <br /> On November 21, 2006,the Board of Supervisors approved Ordinance No. 4308 to add <br /> Development Title Chapter 9-1080, Agricultural Mitigation, to the Development Title. <br /> The purpose of the Chapter is to implement the agricultural land conservation policies <br /> contained in the San Joaquin County General Plan related to permanently protecting <br /> agricultural land within the County. The Board also approved R-06-718 establishing the <br /> Agricultural Mitigation Fee (in-lieu fee). The Fee was set at $8,675.00 per acre. <br /> On March 1, 2011, the Board of Supervisors approved a General Plan Map Amendment, <br /> of Love's Travel Center, (PA-1000183) to change the designation of a 5.06 acre portion <br /> of a 10-acre parcel from General Agriculture (A/G)to Freeway Service (C/FS) and a <br /> Zone reclassification to change the zoning of the same portion of a 10 acre parcel from <br /> General Agriculture, 40-acre minimum (AG-40) to Freeway Service Commercial (C-FS). <br /> Development Title Section 9-1080.3(a) requires agricultural mitigation for a General Plan <br /> Amendment that changes the designation of any land from an agricultural to a non- <br />
