PA-1000131 (LOVE'S TRAVEL CENTER) / (4 DISTRICT) /53os At. 71,r RECOMMENDATION: It is recommended that the Board of Supervisors approve the request to pay the in-lieu fee to fulfill the requirement for agricultural mitigation for Use Permit application No. PA- 1000131. BACKGROUND: On November 21, 2006,the Board of Supervisors approved Ordinance No. 4308 to add Development Title Chapter 9-1080, Agricultural Mitigation, to the Development Title. The purpose of the Chapter is to implement the agricultural land conservation policies contained in the San Joaquin County General Plan related to permanently protecting agricultural land within the County. The Board also approved R-06-718 establishing the Agricultural Mitigation Fee (in-lieu fee). The Fee was set at $8,675.00 per acre. On March 1, 2011, the Board of Supervisors approved a General Plan Map Amendment, of Love's Travel Center, (PA-1000183) to change the designation of a 5.06 acre portion of a 10-acre parcel from General Agriculture (A/G)to Freeway Service (C/FS) and a Zone reclassification to change the zoning of the same portion of a 10 acre parcel from General Agriculture, 40-acre minimum (AG-40) to Freeway Service Commercial (C-FS).
