Hazelton Ave. <br /> Stockton, CA 95205 <br /> Re: Agricultural Mitigation for Love's Travel Center <br /> Dear Ms. Sullivan and Ms. King, <br /> Thank you for the recent meeting regarding the Love's Travel Center Agricultural Mitigation. <br /> This letter is a follow up to that meeting, and a request to bring this matter before the Board of <br /> Supervisors at the earliest possible time. <br /> General Plan Amendment No. PA-10000183 and Zone Reclassification No. PA-1000184 were <br /> approved in March of 2011 and subsequently Use Permit Application No. PA-1000131 was <br /> approved on February 12, 2013. The conditions of the Use Permit, General Plan and Zone <br /> reclassification approvals require that pursuant to Development Title Section 9-1245.2 the 5.06 <br /> acres of this project that were changed from Agricultural Zoning to Commercial-Freeway <br /> Service Zoning in 2011 be mitigated on a 1:1 basis. The balance of the project was zoned <br /> Commercial Freeway Service prior to adoption of the Agricultural Mitigation Ordinance. <br /> On March 22, 2013, I emailed your office and inquired about the process for mitigation. On <br /> March 29, 2013, you responded with the procedures for mitigation. As I understood the <br /> procedures, Love's was to make a reasonable effort to obtain an agricultural easement of 5.06 <br /> acres and offer that easement to the County as mitigation. If Love's was unable to obtain such an <br /> easement and provided your office with evidence of their effort,there is an opportunity to bring <br /> this matter before the Board of Supervisors and request that the Board allow Love's to pay a fee <br /> in-lieu of dedicating an easement. The purpose of this letter is to make such a request. <br /> As you may know, Love's Travel Centers is headquartered in Oklahoma City, OK, and so I <br /> offered to assist Love's in their effort to find an agricultural easement. Mr. Rick Shuffield of <br /> Love's authorized me to undertake such an effort on their behalf. The following outlines my <br /> effort and in addition to making the request to the Board that Love's be allowed to pay the in-lieu <br /> fee. At the end of this letter, I also offer some thoughts and suggestions for amendments to the <br /> current County Ordinance regarding Agricultural Mitigation.
