Throughout this effort, what has become abundantly clear is that because of the small size of this <br /> requirement, and because the legal, transactional, monitoring, and administrative expenses do not <br /> differ greatly between a five acre site and a 200 acre site(for example), the cost per acre on the <br /> smaller sites becomes much higher, and thus the project becomes infeasible from a cost <br /> standpoint when compared to the County fee. Further, even if Love's did have a 5.06 acre parcel <br /> to dedicate, based on the criteria of the Central Valle Farmland Trust, I am nor certain there <br /> would be a responsible entity that would accept the easement for ongoing monitoring and <br /> maintenance. <br /> Based on the foregoing, On behalf of Love's Travel Center's I respectfully request that Love's <br /> be allowed to pay the $8,675.00 per acre fee in-lieu of dedicating an easement. Should the Board <br /> prefer that Love's continue its effort to locate an easement, Love's would further request that <br /> they be allowed to submit the fee as "security" for the easement, which would not result in any <br /> delay in the issuance of their building permit. Then, we would continue efforts to find a 5.06 acre <br /> easement. <br /> Finally, based on my findings through this effort, it is my recommendation that the Board of <br /> Supervisors consider an amendment to the Agricultural Mitigation Ordinance, whereby any <br /> parcels less than 40 acres (the minimum criteria that Mr. Martin mentioned in his email)be <br /> allowed to pay the per acre fee without having to demonstrate an effort to locate an easement for <br /> dedication(for which there likely isn't a recipient). If an applicant happens to have a parcel that <br /> is less than 40 acres and they can find an acceptable entity to the County to accept the easement <br /> for monitoring and maintenance, then they would alternatively be allowed to dedicate an <br /> easement in-lieu of paying the fee. <br /> Please let me know if you have any questions.
