They responded in a memo dated July 16, 2010. The memo states that they <br /> would support this project if the project included three conditions: 1) Demonstrate and <br /> comply with proper lighting restrictions; 2) Demonstrate and comply with all <br /> obstacle/height restrictions; and 3} Enter into an Avi atian easement with Kingdon <br /> Airport and provide for recordation at applicant's expense. <br /> The project site is located within the Kingdon airport's Area of Influence (AIA--Zone 8). <br /> The first two items are requirements of the 2009 Airport Land Use Compatibility Plan for <br /> projects in the AIA. The project was designed to meet these requirements. An Avigation <br /> easement is not an ordinance requirement for this project. However, the applicants have <br /> agreed to the easement as a condition of approval. No design changes are expected as <br /> a result of adding the following condition: <br /> 1.(I) AVIGATION EASEMENT: An avigation easement shall be recorded in favor of the <br /> Kingdon Airport that ensures compliance with the 2009 Airport Land Use Compatibility <br /> Plan. <br /> k4 <br /> f <br />
