PA-1000131 OF HIGHWAY 12 INVESTOR'S LLC <br /> i (C/O MICHAEL HAKEEM) <br /> (FOURTH DISTRICT) <br /> RECOMMENDATION: { <br /> It is recommended that the Board of Supervisors deny the appeal and uphold the Planning <br /> Commission's approval of Use Permit No. PA-1000131. <br /> BACKGROUND: ` <br /> This project is a Use Permit application for a 12-acre truck stop to include a 7,700 square <br /> foot convenience store with an attached 3,000 square foot fast food store, a 3,500 square <br /> foot mechanic building, and a 1,200 square foot storage building. It is located on the east <br /> side of Thornton Road, north of Highway 12, in the Flag City area, directly east of the <br /> existing Pilot-Flying J truck stop(vicinity snap attached). <br /> On March 1, 2011,the Board of Supervisors approved General Pian Map Amendment <br /> application No. PA-1000183 to change 5.06 acres of land with a General Plan designation <br /> of General Agriculture(AIG)to Freeway Service(C/FS)and also approved Zone <br /> Reclassification'application No.PA-1000184 to change the zoning from General <br /> Agriculture, 40-acre minimum(AG40),to Commercial Freeway Service(C-FS). This <br /> approval required annexation into CSA31 (F'lag City). On April 15, 2011,LAFCo <br /> approved the annexation. The 5.06 acres is a part of the 12-acre project site. <br /> On May 19, 2011,the Planning Commission voted 4-0,with one commissioner absent,to <br /> approve Use Permit application No. PA-1000131. On May 27, 2011, the appellant <br /> appealed the approved Use Permit application. <br />
