Analysis <br /> Background <br /> If the project is approved, then approved Lot Line Adjustment Application No.PA-1 000232 will be <br /> recorded so that the project area will become a portion of the lots to the south. The adjacent area was <br /> designated C/FS in 2000. The applicants have submitted Use Permit No. PA-1000131 for a truck stop at <br /> this site. The Use Permit will be heard by the Planning Commission after the traffic study has been <br /> reviewed by the Department of Public Works. <br /> Agricultural Mitigation <br /> Agricultural mitigation will be required for this project. It will be a condition of approval of the underlying <br /> project and must be,implemented before a building permit is issued. The purpose of agricultural mitigation <br /> is to implement the .agricultural land conservation policies contained in the San Joaquin County General <br /> Plan that are related to permanently protecting agricultural land within the County. <br /> The County requires agricultural mitigation for a General Plan Amendment that changes the designation <br /> of any land from an agricultural to a non-agricultural use or a Zoning Reclassification that changes the <br /> permitted uses from agriculture to a nonagricultural use, regardless of the General Plan designation. <br /> Agricultural mitigation shall be satisfied by granting a farmland conservation easement or other farmland <br /> conservation mechanism to, or for, the benefit of a Qualifying Entity. The number of acres of agricultural <br /> mitigation land shall be at least equal to the number of.acres that will be changed to a non-agricultural <br /> use[a 1:1 ratio). <br /> General Plan Policies <br /> Development Title Section 9-803.4 states that prior to approving an application for a General Plan <br /> Amendment, the Planning Commission and the Board of Supervisors shall determine that the internal <br /> consistency of the General Plan is maintained in the adoption of the Amendment. <br /> "f <br /> The Freeway Servicedesignation has the following General Plan requirements(Volume 1, Commercial <br /> Development, Policies,(2)(f)(pages, IV-25-26): <br /> (1). Function: Prd.vide for commercial uses oriented almost exclusively to serving the needs of the <br /> freeway or state highway traveler. <br /> • The underlying project is a commercial truck stop. The truck stop will service travelers on <br /> both Interstate 5 and State Route 12. Therefore,the proposed use meets this function. <br /> (2). Typical Uses:; Travel-related businesses including gasoline service stations, food and beverage <br /> sales, eatingand drinking establishments, and hotels and motels. <br /> • A commercial truck stop is similar to those uses listed. A truck stop may be conditionally <br /> permitted it `the C-FS zone with an approved Use Permit.
