AquaClear Technologies, Inc., warrants each Bio-Pure domestic wastewater treatment plant, when properly registered with AquaClear, to be free of defects in material and workmanship. The company's sole obligation under this warranty is limited to repairing or exchanging any component that, in the company's judgment, shows evidence of defect, provided said component part is returned through an authorized.dealer, transportation prepaid, within two (2) years from the date that treatment system is delivered to the customer. Liability of the company is limited to replacement of the defective component part. The company shall not be liable for transportation or handling of any component part or parts. In no event will AquaClear be liable for loss incurred,because of interruption of service or for consequential damages, or labor or expense required to repair defective units, nor shall this constitute a cause for cancellation of the purchase,agreement. 1 AquaClear reserves the right to revise; change or modify the design of the Bio-Pure treatment plant, or any component parts, without incurring any obligation to make such changes or modifications to equipment or systems'previously sold. The company also reserves the right, in making replacements of components under this warranty, to furnish a component which, in the judgment of AquaClear, is equivalent to the replaced part. Occasional service may be required for the Bio-Pure unit which is not a result of defects in material or workmanship. Damage resulting from accident, alteration, improper use, abuse, or failure to fallow instructions is not covered by this warranty. This warranty is in lieu of all other warranties, expressed or implied, and of all other obligations or liabilities on the company's part. No;dealer or any other person is authorized or permitted to make any other warranty or assume any other obligations or liabilities not strictly in accordance with the provisions of this warranty. Notice to California buyers: A buyer of this product in California has the right to have this product serviced or repaired during the warranty period. The warranty period will be extended for the number of whole days that the product has been out of the buyer's hands for warranty repairs. !f a defect exists within the warranty period, the warranty will not expire until the defect has been fixed. The warranty period will also be extended if the warranty repairs have not been performed due to delays caused by circumstances beyond the control of the buyer, or if the warranty repairs did not remedy the defect and the buyer notifies the manufacturer or seller of the failure of the repairs within 60 days after they were completed.
