CONDITIONS OF APPROVAL <br /> PA-1400062 <br /> Thomas Gianelli <br /> Entertainment Permit application No. PA-1400062 was approved by the San Joaquin County <br /> Community Development Department on May 30, 2014. The effective date of approval is June 9, <br /> 2014. This approval will expire on December 9, 2015, which is 18 months from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with, (2) all necessary building <br /> permits have been secured and remain in force, and (3) all necessary permits from other agencies <br /> have been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Mo Hatef, [209] 468-8477) <br /> a) IMPROVEMENT PLAN: APPLICATION-IMPROVEMENT PLAN". The Site Plan required as a part <br /> of the improvement plan must be prepared by a registered civil engineer or licensed architect. This <br /> Plan must show drainage, driveway access details including gates, on-site parking, landscaping, <br /> signs, existing and proposed utility services, and grading (refer to the "SITE PLAN CHECK LIST" for <br /> details). A fee is required for the Site Plan review. (Development Title Section 9-884) <br /> b) APPROVED USE: This approval is for an Entertainment Permit for a maximum of forty-eight <br /> people for an existing restaurant and bar as shown on the site plan dated March 25, 2014. <br /> c) HOURS OF OPERATION: All entertainment establishments shall be closed and all patrons shall <br /> vacate the premises between 2:00 a.m. and 6:00 a.m., except that as part of a New Year <br /> celebration, entertainment establishments may remain open until 3:00 a.m. on January 1st. <br /> (Development Title Section 9-1085.8 [a]) <br /> d) HOURS OF OPERATION (RESPONSIBLE PERSON): A Responsible Person must be present <br /> in the entertainment establishment during all hours that the entertainment establishment is open <br /> and offering entertainment. (Development Title Section 9-1085.8 [c]) <br /> e) NOISE ABATEMENT: Outdoor establishments shall comply with the requirements of section 9- <br /> 1025.9. <br /> f) ORDERLY DISPERSAL REQUIRED: Each Responsible Person shall use reasonable efforts to <br /> cause the orderly dispersal of patrons from the vicinity of the establishment at closing time. <br /> (Development Title Section 9-1085.14) <br /> g) ALCOHOLIC BEVERAGE ON PREMISES: <br /> i) It is unlawful for any person to bring an alcoholic beverage onto the premises unless such <br /> action is allowed by the entertainment establishment's ABC license. <br /> ii) It is unlawful for any Responsible Person to allow any person to bring an alcoholic beverage <br /> onto the premises unless such action is allowed by the entertainment establishment's ABC <br /> license.
