Decision by the San Joaquin County Board of Supervisors on the Appeal by <br /> Ubiquitel/Complete Wireless of the San Joaquin County Planning Commission's <br /> Denial of Site Approval No. PA-0600283 of John Vanderwerff. <br /> Introduction: <br /> On or about May 12, 2006, Appellant Ubiquitel/Complete Wireless through John <br /> Vanderwerff submitted a Site Approval Application to the San Joaquin County <br /> Community Development Department to build a 120 foot high monopole cell tower with <br /> antennas and related equipment shelter to be contained within a 2,500 sq. ft. fenced area. <br /> On September 7, 2006, after considering oral and written testimony,the Planning <br /> Commission voted 3-2 to deny application PA-0500578. On September 14, 2006, the <br /> applicant appealed the Planning Commission's decision to the Board of Supervisors. On <br /> October 24, 2006, after receiving oral testimony and written evidence on the appeal of the <br /> Planning Commission's decision, the San Joaquin County Board of Supervisors voted <br /> unanimously to uphold the Planning Commission's decision. <br /> Facts: <br /> The applicant applied for a Site Approval to construct a 120-foot tall <br /> telecommunications monopole and equipment shelters in AU-20 zone. According to the <br /> applicant the location chosen would improve cell phone coverage for the neighborhood <br /> and for Highway 120 travelers. The 120 foot monopole would permit the collocation of <br /> up to three other carriers on the tower. A Site Approval for a telecommunications <br /> monopole in the AU-20 zone would normally be processed at Community Development <br /> Department staff level. However, it was referred to the Planning Commission because of <br /> neighborhood opposition. A memo from the Manteca Unified School District dated June <br /> 8, 2006 and one petition with ten signatures were received by the Community <br /> Development Department in opposition to the project. <br /> The proposed location for the tower was 20972 S. Tinnin Road, Manteca. This is <br /> a 10.02 acre parcel located on the east side of Tinnin Road, 2000 feet south of Woodward <br /> Avenue, south of Manteca. The parcel is within the City of Manteca Sphere of Influence. <br /> The City of Manteca General Plan indicates that the area will eventually be zoned <br /> residential. <br /> Planning Commission Hearing: <br /> Jillian Faria and Steven Smith represented Ubiquitel at the Planning Commission <br /> hearing. Ms. Faria stated that the project area was identified as being under served by <br /> cell carriers. Ubiquitel sent letters to property owners in the vicinity with properties that <br /> were greater than 10 acres in size. <br /> Mr. Smith testified before the Planning Commission that Ubiquitel examined <br /> other sites and sent letters to other property owners in the area, but was unable to locate <br /> I <br />
