Analysis <br /> Background <br /> A Site Approval for a telecommunications monopole in the AU-20 zone would normally be processed at staff <br /> level. However, it is being referred to the Planning Commission because of neighborhood opposition. <br /> Land Use <br /> The proposed project is a "Communications Services-Type II" use type that may be conditionally permitted <br /> in the Agriculture-Urban Reserve zone with an approved Site Approval application. <br /> The 10.02 acre site contains one primary dwelling with a pool, a Second Unit Dwelling, and a detached <br /> garage. All the structures are in the southwest corner of the parcel. The monopole will be located near the <br /> southern boundary of the project parcel, approximately 120 feet east of the detached garage. The nearest <br /> residence on an adjoining parcel is approximately 300 feet to the southwest. <br /> This project complies with the Development Title Section 9-1065.4[d] that requires"new freestanding <br /> support structures to be located a distance equal to at least the height of the said structure from residential <br /> structures on adjoining properties." <br /> Co-Location <br /> Development Title Section 9-1065.5 states that unless shown not to be feasible for the applicant or <br /> considered not to be desirable by the Planning Commission, a new wireless telecommunication facility must <br /> collocate on an existing wireless telecommunications facility or, if an existing wireless telecommunications <br /> facility is not present within the coverage area of the proposed facility, on an existing structure or building on <br /> publicly owned or controlled property. <br /> The applicant contacted the owners of the two towers located in the area. The first tower is owned by the <br /> City of Manteca and is located on the east side of Union Road, approximately 1000 feet north of State Route <br /> 120, in the City of Manteca. The applicant was told that there is no space available for carriers on the tower. <br /> The second tower is owned by T-Mobile and is located east of Manteca Road and north of State Route 120 <br /> at 1153 Vanderbilt Circle, in the City of Manteca. Although the tower had room for an additional set of <br /> antennas, there was not enough ground space for the equipment. The land owner was not willing to lease <br /> more land area because it would interfere with his existing business. <br /> Neighborhood Opposition <br /> The Community Development Department received one petition with ten signatures in opposition to the <br /> project. The petition sited land use conflicts, safety, and a possible future residential neighborhood as <br /> reasons for their opposition. <br /> Proposed Residential Neighborhood <br /> The petition states that there a tentative map and a school proposed for this area and that there is an <br /> approved map for a residential neighborhood within '/z mile of the proposed site. <br /> The City of Manteca was mailed a referral on May 26, 2006. They have not responded as of August 20, <br /> 2006. Telecommunications monopoles may be conditionally approved near schools or residences or within <br /> a residential neighborhood.
