Recommendations <br /> Action <br /> It is recommended that the Planning Commission: <br /> 1. Approve the Negative Declaration, and <br /> 2. Approve Site Approval Application No. PA-0600283 with the Findings and Conditions of <br /> Approval contained in the staff report. <br /> Findings <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, <br /> any applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the establishment, maintenance and operation of a <br /> telecommunications monopole do not conflict with the General Plan. The use proposed is <br /> consistent with the Residential Low Density (R/L) General Plan designation and may be <br /> conditionally permitted with an approved Site Approval in the AU-20 zone. There are no <br /> Master Plans, Specific Plans, or Special Purpose Plans in the project vicinity. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the project will exceed the thirty-foot setback <br /> requirement of the AU-20 zone and the Lathrop-Manteca Fire District is proposing a <br /> condition of approval for a fire road. The Public Works Department did not require any <br /> improvements to Tinnin Road. This project does not need a well or septic system. Also, all <br /> utilities, improvements, and other necessary facilities exist or will be provided as reflected <br /> in the approved site plan. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the open, flat, agricultural land is well suited for the <br /> construction of a 120-foot-tall telecommunications monopole. No wells or septic systems <br /> are required or proposed for this project. There are no residences within the 120-foot fall <br /> zone of the tower. There are no existing towers available for co-location in the vicinity. <br /> 4. Issuance of the permit will not be significantly detrimental to the public health, safety, or welfare, or be <br /> injurious to the property or improvements of adjacent properties. <br /> • This finding can be made because an Initial Study prepared for this project found no <br /> potentially significant environmental impacts, and the tower must comply with Federal <br /> Communications Commission regulations regarding radio frequency emissions. <br /> San Joaquin County PA-0600283Nanderwerff <br /> Community Development Page 5 <br />
