CONDITIONS OF APPROVAL <br /> QX-99-1 <br /> McGah & Peterson <br /> Quarry Excavation Application No. QX-99-1 was approved by the San Joaquin County Planning <br /> Commission on September 2, 1999. The effective date of approval is September 12, 1999. This <br /> approval will expire on March 13, 2001, which is 18 months from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits <br /> have been secured and remain in force, and (3) all necessary permits from other agencies have <br /> been secured and remain in force. <br /> Unless otherwise specified,all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT(Staff Contact: Tom Gau, 468-2344) <br /> a. APPROVAL: This approval shall be for a phased six-year excavation of the 111-acre portion of the <br /> 137-acre project site, as shown on the approved Mining and Reclamation Plan dated May 4, 1999, <br /> The Reclamation Plan text is attached as Exhibit A. <br /> b. RECLAMATION PLAN: The Mining and Reclamation Plan shall be prepared by a registered Civil <br /> Engineer and show drainage, driveway access details, on-site parking, existing and proposed utility <br /> services, grading, and reclamation. Storm drainage runoff shall be retained on the site. The <br /> drainage pattern and corresponding storm drain improvements shall be shown on the Plan. A plan <br /> check fee as specified by Section 9-240 will be required. The Mining and Reclamation Plan shall <br /> be prepared in accordance with the reclamation standards developed pursuant to Surface Mining <br /> Reclamation Act(SMARA) Section 2773(b)and approved by all agencies with permit authority prior <br /> to initiating the use. <br /> c. STOCKPILES AND SCREENING: No stockpiled soil or material shall be placed closer than 25 <br /> feet to a property boundary except where shown on plans to provide a landscape berm or screening <br /> (provided sight distances at road intersections are not impaired). (Development Title Section 9- <br /> 1415.3[b]) <br /> d. PRIVATE ROADS: All private roads involved in an excavation shall be maintained so as to control <br /> the creation of dust. The first 100 feet of any private road on the property which intersects with a <br /> publicly maintained road shall be surfaced in a manner approved by the Director. Traffic control <br /> and warning signs shall be installed, if required, at such intersections. The placement and size of <br /> these signs shall be approved by the Director of Public Works. EROSION CONTROL: Protective vegetative planting, silt screen dams, or other approved methods <br /> shall be required where necessary for the control of erosion. An erosion and sediment control plan <br /> approved by the Development Services Division shall be part of the reclamation plan. <br /> (Development Title Section 9-1415.3[d]) <br /> f. PERFORMANCE STANDARDS: Standards contained in Chapter 9-1025 shall be met unless <br /> otherwise modified by conditions of the Quarry Excavation Permit.
