b. The excavation plan shall be prepared by a Registered Civil Engineer and include the following: (1) Detail of the access road (the first 100 feet from Tracy Boulevard shall be paved). (2) A plan of the haul route for County roads. (3) A stockpile area for top soil(no excavation or stockpile shall be allowed within 25 feet of the property boundary or the County right-of-way). (4) Public roads shall be kept free from mud, dirt, and gravel resulting from quarry operations. c. A private roads involved in an excavation shall be maintained so as to control dust. d. A videotape of the planned haul route shall show conditions of all County roads. The condition of San Joaquin County maintained roads along the haul route shall be reviewed with the Department of Public Works prior to the start of excavation. (Development Title Section 9-1415.2) e. Loads on all public roads shall be required to be legal loads only. (Street and Highway Title Section 10-2350) f. An encroachment permit shall be required for work within the road right-of-way. (Development Title Sections 9-1145.4 and 9-1145.5) g. A cash deposit or security in the amount and form acceptable to the Department of Public Works shall be filed with the Department with a guarantee that if the permittee fails, refuses, or neglects to repair, under permit, and damages to any County roads along the haul route which may result from the permittee's operation, the Department of Public Works may do the work necessary to restore County roads along the haul route to equal or better than original conditions, using the funds from said cash deposit or security. A Maintenance Agreement shall be executed by the applicant to ensure that Tracy Boulevard, Linne Road, Banta Road, and Eleventh Street are maintained to a condition acceptable to San Joaquin County. In lieu of the Maintenance Agreement, a one time road maintenance fee may be acceptable to the County. Application for the in-lieu fee may be made to the Department of Public Works. i. The Traffic Impact Mitigation Fee shall be required for this development. The fee is due and payable at the time of building permit application. The fee currently is$190.77 per trip-end in the Tracy area. The fee shall be automatically adjusted July 1 of each year by the Engineering Construction Cost Index as published by the Engineering News Record. The number of trip-ends may be determined by a proportion to the length in time of the excavation operation. (Resolution R-00-33) j. Caltrans has determined that this project will contribute to cumulative impacts at the overcrossing of Tracy Boulevard at 1-580. The applicant shall pay Caltrans impact fees on a"fair share" basis towards future improvements at this intersection. k. The applicant shall contact the Caltrans Landscaping Department([209]948-3655)for comments and approval prior to the planting of any tree species between the property line and 1-580. 3. ENVIRONMENTAL HEALTH DEPARTMENT(Staff Contact: Mike Huggins,468-3437) a. No excavations are permitted into the groundwater table without specific approval from the Regional Water Quality Control Board, Central Valley Region (California Water Code, Chapter 4, Article 3, Section 13240).
