b. The excavation plan shall be prepared by a Registered Civil Engineer and include the following: <br /> (1) Detail of the access road (the first 100 feet from Tracy Boulevard shall be paved). <br /> (2) A plan of the haul route for County roads. <br /> (3) A stockpile area for top soil(no excavation or stockpile shall be allowed within 25 feet of the <br /> property boundary or the County right-of-way). <br /> (4) Public roads shall be kept free from mud, dirt, and gravel resulting from quarry operations. <br /> c. A private roads involved in an excavation shall be maintained so as to control dust. <br /> d. A videotape of the planned haul route shall show conditions of all County roads. The condition of <br /> San Joaquin County maintained roads along the haul route shall be reviewed with the Department of <br /> Public Works prior to the start of excavation. (Development Title Section 9-1415.2) <br /> e. Loads on all public roads shall be required to be legal loads only. (Street and Highway Title Section <br /> 10-2350) <br /> f. An encroachment permit shall be required for work within the road right-of-way. (Development Title <br /> Sections 9-1145.4 and 9-1145.5) <br /> g. A cash deposit or security in the amount and form acceptable to the Department of Public Works <br /> shall be filed with the Department with a guarantee that if the permittee fails, refuses, or neglects to <br /> repair, under permit, and damages to any County roads along the haul route which may result from <br /> the permittee's operation, the Department of Public Works may do the work necessary to restore <br /> County roads along the haul route to equal or better than original conditions, using the funds from <br /> said cash deposit or security. A Maintenance Agreement shall be executed by the applicant to ensure that Tracy Boulevard, Linne <br /> Road, Banta Road, and Eleventh Street are maintained to a condition acceptable to San Joaquin <br /> County. In lieu of the Maintenance Agreement, a one time road maintenance fee may be acceptable <br /> to the County. Application for the in-lieu fee may be made to the Department of Public Works. <br /> i. The Traffic Impact Mitigation Fee shall be required for this development. The fee is due and payable <br /> at the time of building permit application. The fee currently is$190.77 per trip-end in the Tracy area. <br /> The fee shall be automatically adjusted July 1 of each year by the Engineering Construction Cost <br /> Index as published by the Engineering News Record. The number of trip-ends may be determined <br /> by a proportion to the length in time of the excavation operation. (Resolution R-00-33) <br /> j. Caltrans has determined that this project will contribute to cumulative impacts at the overcrossing of <br /> Tracy Boulevard at 1-580. The applicant shall pay Caltrans impact fees on a"fair share" basis <br /> towards future improvements at this intersection. <br /> k. The applicant shall contact the Caltrans Landscaping Department([209]948-3655)for comments <br /> and approval prior to the planting of any tree species between the property line and 1-580. <br /> 3. ENVIRONMENTAL HEALTH DEPARTMENT(Staff Contact: Mike Huggins,468-3437) <br /> a.
