Biological Resources, MONK &ASSOCIATES <br /> Impacts and Mitigations <br /> Tracy Facility Expansion Site <br /> Notice of Termination must be submitted. A General Storm Water Permit is required after that <br /> for the ongoing operation unless the stormwater is fully captured on the site. <br /> 12.2.3 APPLICABILITY TO THE PRO= <br /> Pursuant to Section 401 of the Clean Water Act,it will be necessary for Granite to apply fora <br /> certification or waiver of water quality from the RWQCB prior to installing culverts in Corral <br /> Hollow Creek. Pursuant to Section 402 of the Clean Water Act, since mining activities will <br /> require disturbing greater than 5 acres of land, Granite's engineer will have to submit an NOT <br /> and SWPPP prior to initiation of mining. in addition, a General Storm Water Permit would be <br /> required for the ongoing mining operation. <br /> 12.3 California Department of Fish and Game <br /> Under Sections 1601-1603 of the California Fish and Game Code, CDFG regulates activities that <br /> divert,obstruct, or alter stream flow,or substantially modify the bed, channel, or bank of a stream <br /> or its riparian vegetation. Any proposed activity that would result in any of these modifications to <br /> a natural stream channel would require entering into a Streambed Alteration Agreement(SBAA) <br /> with CDFG prior to commencing with work in the stream. However,prior to authorizing such <br /> permits, CDFG typically reviews an analysis of the expected biological impacts, any proposed <br /> mitigation plans that would be implemented to offset biological impacts,and engineering and <br /> erosion control plans. When reviewing proposed development plans, CDFG examines stream set- <br /> back proposals, and typically requires set-backs of 25 feet to a 100 feet from the"top-of-bank." <br /> When proposed projects would not result in significant adverse biological impacts,or if such <br /> impacts would be adequately mitigated to a level considered less than significant,CDFG will enter <br /> into a SBAA with project applicants. The SBAA presents conditions that the applicant must <br /> follow to remain in compliance with Fish and Game Code. <br /> I <br /> 12.3.1 APPLICABILITY To THE PROJECT <br /> Corral Hollow Creek and a buffer area around this creek would not be mined at any time during <br /> the life of the mining project. The creek corridor is set-aside from the mining plan in a protected <br /> area that is ranges from approximately 500 feet wide on the western one-third of the creek <br /> alignment,to 300 feet wide on the eastern portion of the creek alignment. The total protected <br /> area within Corral Hollow Creek includes the 4.40-acre streambed plus a 10.5$-acre set-aside <br /> within the steam channel. The total protected area would be 14.98 acres, minus the width of a <br /> temporary road crossing that would be installed and removed each year during a two-year period <br /> begriming the first year of excavation. Installation of culverts in Corral Hollow Creek for the road <br /> crossing will require entering into a Streambed Alteration Agreement with CDFG prior to initiating <br /> the installation activity. <br /> I <br /> 24 <br />
