W G]R, <br /> Southwest, Inc. <br /> SUMMARY <br /> PHASE I ENVIRONMENTAL SITE ASSESSMENT <br /> 79.70-acre Agricultural Property <br /> 16848 N.Tully Road/Sargent Road <br /> Lockeford,California <br /> WGR Southwest, Inc. (WGR) conducted a Phase I Environmental Site Assessment <br /> investigation at the above-referenced site. The investigation was conducted in accordance <br /> with the American Society for Testing and Materials (ASTM) Standard Practices E 1527-00 <br /> in order to determine the presence or likely presence of any hazardous substances or <br /> petroleum products at or beneath the subject property and for the user to "satisfy one of the <br /> requirements to qualify for the `innocent landowner' defense to CERCLA liability" (ASTM <br /> E 1527-00). <br /> Results of this investigation indicate that the property has been utilized primarily as agricultural <br /> rangeland and farmland prior to 1953 until the present time. Property deeds could only be <br /> located dating back to 1986 when the property was owned by Mamie W. Pettengill. It appears <br /> _ that the property ownership was subsequently distributed to the remaining family members on <br /> August 31, 1987 after the death of the owner. The property ownership was transferred to the <br /> existing owner, Miguel Anaya Etal, on January 8, 2002. The San Joaquin County Assessors <br /> _ Office map shows the property as a Williamson Act Parcel. Under the California Land <br /> Conservation (Williamson) Act of 1965, local governments and property owners may <br /> voluntarily enter into contracts to commit land to be an agricultural preserve for a period of 10 <br /> _ or more years. The status of the contract for the current property is unknown, however, <br /> according to the San Joaquin County Assessor office, to terminate the contract requires up to <br /> nine years and a significant cancellation penalty fee. <br /> A standard record review according to ASTM E 1527-00 was conducted for the subject <br /> property. The record review included publicly obtainable database regulatory records <br /> concerning the subject site and adjacent properties within a one-mile radius area of the site. <br /> Because of the size of the facility the database search was expanded by an extra 1/8 of a mile. <br /> No potential problems were identified by the database search. A search of the San Joaquin <br /> County Environmental Health Department files found no info atio onh . �» P_.:t,site. The <br /> San Joaquin County Agricultural Commissioner also h cords of pesticides used by the <br /> current or relatively recent previous owners. <br /> An inspection of the site and the surrounding areas did not reveal any significant environmental <br /> problems or threats to the subject property. Sensitive environmental receptors on or near the <br /> subject property include Paddy Creek, seasonally dry drainage courses, potential vernal pools, <br /> and domestic and agricultural water supply wells. <br /> At this point, in the opinion of WGR, there are no apparent environmental issues connected <br /> with the subject site or neighboring properties that require further investigation or assessment. <br />
