CONDITIONS OF APPROVAL <br /> PA-02-165 <br /> Franke <br /> Site Approval Application No. PA-02-165 was approved by the San Joaquin County Community <br /> Development Department on June 14, 2002. The effective date of approval is June 24, 2002. This <br /> approval will expire on December 24, 2003, which is 18 months from the effective date of approval, <br /> unless (1) all Conditions of Approval have been complied with, (2) all necessary building permits <br /> have been secured and remain in force, and (3) all necessary permits from other agencies have <br /> been secured and remain in force. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to the establishment of the use and the issuance of any building permits. Those Conditions <br /> followed by a Section Number have been identified as Ordinance requirements pertinent to this <br /> application. Ordinance requirements cannot be modified, and other Ordinance requirements may <br /> apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: Jennifer Jolley, 468-3161) <br /> a. BUILDING PERMIT: Submit a "RESIDENTIAL-BUILDING PERMIT". The Site Plan required as a <br /> part of the building permit must show drainage, driveway access details including gates, on-site <br /> parking, landscaping, signs, existing and proposed utility services, and grading (refer to the "SITE <br /> PLAN CHECK LIST" for details). A fee is required for the Site Plan review. (Development Title <br /> Section 9-884) <br /> b. APPROVED USE: This approval is to permit a private right-of-way from Collier Road to Lot 9 (parcel <br /> 021-030-47) on Tully Road (private) in the Small Farms Improvement Tract, Division N. The approval <br /> also permits construction of a residence in the designated area shown on the Plan dated April 22, <br /> 2002. <br /> c. ROADWAY STANDARDS: The entire length of the private right-of-way, and any required <br /> secondary method of access, from a maintained county, city, or state road to the driveway <br /> serving the development shall be constructed and maintained to the standards required by <br /> Section 10.207 of the Uniform Fire Code and applicable San Joaquin Improvement Standards. <br /> (Development Title Section 9-1150.14[a]) <br /> d. RIPARIAN HABITAT: Parallel to Coyote Creek, a natural open space area for riparian habitat and <br /> waterway protection shall be maintained to provide nesting and foraging habitat and the protection of <br /> waterway quality. The minimum width of said open space shall be one-hundred (100) feet, <br /> measured from the mean high water level of the natural bank or fifty (50) feet back from the existing <br /> riparian habitat, whichever is greater. Water-dependent uses may be permitted in this buffer. The <br /> mean high water level and the edge of the riparian habitat shall be shown on the Site Plan. The <br /> open space buffer required above shall be shown on the Site Plans with the following note: <br /> (1) Pursuant to Section 9-1510.5 of the San Joaquin County Development Title, this area is <br /> designated as a natural open space for riparian habitat and waterway protection. No <br /> development other than water dependent uses shall be permitted in this space. <br /> e. TREE PRESERVATION: Future development on the parcel shall be consistent with the <br /> requirements of the County's Tree Preservation Ordinance (Development Title Section 9-1505.2). <br /> Conditions of Approval - 1 - PA-02-165 <br />
