The owner shall execute an Irrevocable Offer and Agreement to Dedicate Road to result in a <br /> twenty-five(25) foot wide right-of-way along the west and north property lines of <br /> APN 021-030-45. The construction of the frontage improvements will be deferred upon execution by the <br /> owner of a Deferred Frontage and Roadway Improvement Agreement of a Secured Deferred <br /> Frontage and Roadway Improvement Agreement with a deposit equivalent to their estimated <br /> construction costs prior to approval of the Improvement Plan. (A$325.00 fee currently is <br /> required for processing per Development Title Table 9-240.2 in addition to a copy of the Grant <br /> Deed and an estimate for the required frontage improvements. The estimate shall be prepared by <br /> a registered civil engineer with a typical section drawing on a form to be supplied by the <br /> Department of Public Works for approval. As an option, the Department of Public Works will <br /> Prepare the drawing and estimate for an additional fee of$140.00.) (The fee due will be based <br /> on the current fee schedule.) (Development Title Section 9-1150.2) <br /> 6. The private road shall be required to improved in accordance with the requirements of Uniform <br /> Fire Code Section 10.207. <br /> 7. This area has been subject to historic flooding and portions of all parcels are located within the <br /> 100-year floodplain where base flood elevations have not been determined. Therefore, the <br /> applicant shall obtain a finished floor elevation from San Joaquin County Department of Public <br /> Works, Storm Water Management Division for all new structures and substantial improvements <br /> constructed on all parcels. <br /> 8. Coyote Creek(Creek)passes through the subdivision. Therefore, the final Site Map shall <br /> delineate the Creek with a 25-foot building setback from the top of both banks. <br /> 9. The applicant shall keep the Creek free of obstacles which impede the flow of water.
