Turner Road ENVIRONMENT HEALTH <br /> Lodi, CA 95242 PERMIT/SE�iViCES <br /> NOTICE OF VIOLATION, FAILURE TO INCLUDE PROFESSIONAL CERTIFICATION, <br /> SALINITY RED UCTION STUDY WORKPLAN AND OPERA TION AND MAINTENANCE PLAN, <br /> JESSIE'S GROVE WINERY, SAN JOA QUIN COUNTY <br /> Staff has determined that the 10 March 2005 Salinity Reduction Study Workplan and 10 March 2005 <br /> Operation and Maintenance Plan prepared by Neil O. Anderson and Associates (NOA) were submitted <br /> without professional certifications. Professional certification of each of the reports is required by <br /> Provision G.2 of Waste Discharge Requirements Order No. R5-2004-0079 and by the California <br /> Business and Professions Code Sections 6735, 7835, and 7835.1. <br /> Please provide professional certification of each of the reports so that staff can proceed with reviewing <br /> them. The certification should be submitted as soon as possible. It should be noted that Jessie's Grove <br /> is significantly behind the schedule presented in the 2 December 2004 Notice of Violation, Failure to <br /> Submit Technical and Monitoring Reports. That letter stated the following: <br /> Due to the failure to submit the required reports pursuant to Section 13267 of the California <br /> Water Code, staffs usual next step is to recommend to management that civil liability (i.e., <br /> monetary penalties) be assessed against the Discharger. As of 1 December 2004, the maximum <br /> liability for the delinquent reports listed above is $452,000. <br /> However, staff will not recommend that the Executive Officer issue an Administrative Civil <br /> Liability Complaint if the delinquent reports are submitted no later than 1 March 2005. Note <br /> that the reports must contain all the information described in the Provisions section of the <br /> WDRs. They must also be completed by a registered professional, as described in the WDRs. In <br /> addition, the monitoring reports must be submitted monthly, beginning with the December 2004 <br /> monitoring report, which is due by 1 February 2005. <br /> Continued failure to submit complete technical reports may result in enforcement activity including <br /> imposition of Administrative Civil Liabilities (fines).
