CONDITIONS OF APPROVAL <br /> PA-1300116 <br /> FOOTHILL RESOURCE PARTNERS LLC/DILLON & MURPHY <br /> Minor Subdivision Application No. PA-1300116 was approved by the Community Development <br /> Department on October 11, 2013. The effective date of approval is October 21, 2013. This tentative <br /> map approval will expire on October 20. 2016, which is three (3) years from the effective date of <br /> approval, unless (1) all Conditions of Approval have been complied with and (2) a Parcel Map has <br /> been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application. TENTATIVE MAP: The Parcel Map shall substantially conform with the approved tentative map <br /> dated July 12, 2013. <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note shall <br /> be placed on the Parcel Map and recorded as a Notice of Minor Subdivision Restriction: <br /> All persons purchasing parcels within the boundaries of this approved map should be <br /> prepared to accept the inconveniences or discomforts associated with agricultural operations <br /> or activities, such as noise, odors, insects, dust or fumes. San Joaquin County has <br /> determined that such inconveniencies or discomforts shall not be considered to be a <br /> nuisance. <br /> c. LOT SIZE AND WIDTH:The following lot size and width regulations shall apply to this map: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard <br /> setback line. (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 10 acres. (Development Title Section 9- <br /> 610.3(e)[2]) <br /> d. PROPERTY LINE SETBACK: (The following requirements shall apply) <br /> (1) The proposed new side and rear property lines for Parcel 1 and the Designated Remainder shall <br /> meet the side setback requirements for the AG-40 (General Agriculture, 40-acre minimum) <br /> zoning designation for non-agricultural and agricultural structures.
