Storing both the facility wastewater and the runoff from confined animal facilities that <br /> CWA section 319 is caused by storms up to and including a 25-year, 24-hour frequency storm. In addition,,40 CFR 122.23(c) provides that the <br /> Director of an NPDES discharge permit program may designate any animal feeding operation as a <br /> concentrated animal feeding operation (which has the effect of subjecting the operation to the <br /> NPDES permit program requirements) upon determining that it is a significant contributor of water <br /> pollution.
