Hazelton Avenue <br /> Stockton, California 95202 <br /> SUBJECT: Proposed Site Approval and Certification of Negative Declaration for <br /> Poultry Farm on Roberts Island, San Joaquin County (PA-0500729) <br /> Dear Chair Stockar: . a <br /> The staff of the Delta Protection Commission (Delta Commission) has reviewed the Community <br /> Development Department's recommendations for the subject proposal.to be considered by the <br /> Planning Commission on May 4, 2006. <br /> While the Delta Commission received notification of the meeting (May 2, 2006), please note that <br /> it was not included to receive the application referrals that were indicated in the staff report as <br /> having been mailed on October 28, 2005 and January 17, 2006- Therefore, you are requested to <br /> take into consideration the comments provided herein when considering the project for approval <br /> and/or with respect to the inclusion of conditions of approval. <br /> From the information provided, Delta Commission staff has determined that the proposed project <br /> is located within the Primary Zone of the Legal Delta and is, therefore, subject to consistency <br /> with the Land Use& Resource Management Plan for the Primary Zone of the Delta <br /> (Management Plan). Actions for approval or denial of projects in the Primary Zone are subject <br /> I to possible appeal to the Delta Commission. <br /> j The Delta Protection Act (Act) was enacted-in 1992 in recognition of the,increasing threats to the <br /> resources of the Primary Zone of the Delta from urban and suburban encroachment having the <br /> potential to impact agriculture,wildlife habitat, and recreation uses. Pursuant to the Act, the <br /> Management Plan was completed and adopted by the Commission in 1995. <br /> I <br /> The Management Plan sets out findings, policies, and,recommendations resulting from <br /> background studies in the areas of environment, utilities and infrastructure, land use, agriculture, <br /> water, recreation and access, levees, and marine patrol/boater education/safety programs.
