CONDITIONS OF APPROVAL <br /> PA-1100132 <br /> OLAGARAYISEIBEL <br /> Minor Subdivision Application No. PA-1100132 was approved by the San Joaquin County <br /> Community Development Department on October 10, 2011. The effective date of approval is <br /> October 20, 2011. This tentative map approval will expire on October 19, 2014, which is three years <br /> from the effective date of approval, unless (1) all Conditions of Approval have been complied with <br /> and (2) a Parcel Map has been filed with and accepted by the County Surveyor. <br /> Unless otherwise specified, all Conditions of Approval and Ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map. Those Conditions followed by a Section Number have been <br /> identified as Ordinance requirements pertinent to this application. Ordinance requirements cannot <br /> be modified, and other Ordinance requirements may apply. <br /> 1. COMMUNITY DEVELOPMENT DEPARTMENT (Staff Contact: John Funderburg, 468-3160 ) <br /> a. CERTIFICATE OF COMPLIANCE: A Certificate of Compliance is required for all parcels. The <br /> property descriptions submitted with the Certificate of Compliance application shall substantially <br /> conform with the approved Revised Tentative Map dated August 24, 2011. A fee is required to <br /> process the Certificate of Compliance application. (Development Title Section 9-890.4) <br /> b. RIGHT TO FARM: Pursuant to San Joaquin County Code Section 6-9004(b), the following note <br /> shall be recorded as a separate instrument with the Certificate of Compliance: <br /> All persons purchasing parcels within the boundaries of this approved map should be prepared to <br /> accept the inconveniences or discomforts associated with agricultural operations or activities, such <br /> as noise, odors, insects, dust or fumes. San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance. <br /> c. LOT SIZE AND WIDTH: The following lot size and width regulations shall apply: <br /> (1) All parcels shall have a minimum lot width of 330 feet, measured at the front yard setback line. <br /> (Development Title Section 9-610.4) <br /> (2) All parcels shall have a minimum lot area of 40 gross acres. (Development Title Section 9-610.4) <br /> d. ACCESS: The following access requirements apply and shall be included in the Certificate of <br /> Compliance property description: <br /> (1) The property description for the Certificate of Compliance shall include a minimum 25-foot wide <br /> easement for access from Vail Road to Parcel One and Parcel Two. <br /> (2) Prior to any grant of approval for a development project or issuance of a building permit on <br /> Parcel One or Parcel Two the easement shall be constructed and maintained to the standards <br /> required by Section 10 207 of the Uniform Fire Code and applicable San Joaquin County <br /> Improvement Standards. (Development Title Section 9-1150.151c]) <br /> e. FLOOD HAZARDS: Future construction on the parcel(s) shall be consistent with the requirements <br /> of the Flood Hazards Chapter. (Development Title Section 9-1605) <br />
