PA-0300245 OF ELINOR <br /> LUTZ, ETAL (C/O LARRY MASON) (APN: 229-210-18) (ADDRESS: <br /> 17219 VICTORY ROAD, ESCALON) <br /> The project is to permit the storage of portable toilets as an accessory use to a farm <br /> services operation. The 9.7 acre parcel has a General Plan designation of A/L (Limited <br /> Agriculture) and is zoned AL-10 (Limited Agriculture-10). The project is located on the <br /> west side of Victory Road, 4,400 feet north of Yosemite Road, northeast of Escalon. <br /> ACCESSORY USE <br /> Development Title Section 9-110.3 states that "Accessory" means a building or a use <br /> that is compatible with, and incidental or subordinate to, the main structure or the main <br /> use of the land and is located on the same lot. The project is proposed as an accessory <br /> use to a farm services operation. There is no history of a farm services operation at this <br /> location. Therefore, the storage of portable toilets cannot be considered an accessory <br /> use. <br /> FARM SERVICES <br /> Development Title Section 9-115.445 states that the Farm Services use type refers to <br /> administrative services, soil preparation services, and plant crop services, and the <br /> storage of farm equipment and materials for said services, provided to farming on a fee <br /> or contract basis. Excluded are those uses classified under the Agricultural processing <br /> use type. Typical uses include farm headquarters offices and contract harvesting done <br /> primarily by machine. The storage of portable toilets is not considered to be a farm <br /> service use and is classified under the use type Wholesale and Distribution-Heavy. <br /> Development Title Section 9-115.585 defines Wholesale and Distribution-Heavy as <br /> open-air storage, distribution, and handling of materials and equipment. Typical uses <br /> include monument or stone yards, and open storage yards. The Wholesale and <br /> Distribution-Heavy use type may be conditionally permitted in the I-W (Industrial- <br /> Warehouse) and I-G (Industrial-General) zone. <br /> 1 <br />
