MS-93-134 OF JOE BUDISELICH, <br /> ET AL (C/O WONG ENGINEERS) to subdivide, with a phased tentative <br /> map, a 17.5-acre parcel into 13 commercial and industrial lots and <br /> a designated remainder of 4.3 acres. The project site is located <br /> on the south side of Waterloo Road, just east of Piccoli Road, east <br /> Stockton (Supervisorial District 2) . <br /> Associate Planner Chandler Martin introduced a staff report into <br /> the record. He asked that recommended Condition of Approval No. <br /> 1(c) be revised (see motion) . <br /> Senior Civil Engineer Tom Iwamiya, representing the Department of <br /> Public Works, asked that Conditions of Approval Nos. 2 (h) and 2 (s) <br /> be revised (see motion) . <br /> Chief Deputy County Counsel Mike McGrew explained that litigation <br /> is pending concerning the use of County Service Area (CSA) No. 15. <br /> He said that this matter should not have any direct bearing on the <br /> Commission' s decision on this application because the decision is <br /> based on whether services are going to be provided and not how they <br /> will be provided. , , <br /> PUBLIC HEARING OPENED <br /> PROPONENTS: Attorney Jerry Sperry, representing Mr. Budiselich, <br /> the applicant, said that the change to Condition No. 2 (h) was made <br /> at his request. He said he did not object to the change to <br /> Condition No. 2 (s) but asked for further modification of it by <br /> stating that "The subdivider shall mitigate any problems identified <br /> in the traffic study caused by this project. " <br /> Mr. Iwamiya concurred with that change. <br /> OPPONENTS: Attorney Michael Normoyle (1700 Standiford Ave, Suite <br /> A-340, Modesto) , was present to represent Waterloo Park Plaza, a <br /> Partnership consisting of Ernest Giannecchini, Rena Campodonico and <br /> Adrianne Jensen; Donald G. Schrader and Craig Schrader; Patricia J. <br /> Flannigan on behalf of Denny' s Inc. , ; Deanna Federico on behalf of <br /> Brooks Ranch; William Norby on behalf of Waterloo Shell; Vito Di <br /> Leo; Allen Beebe, on behalf of Taco Bell and Ronald Young, dba Best <br /> Western-Stockton Inn. <br /> Mr. Normoyle submitted 19 documents, identified by number 2 through <br /> 20, and these were placed in the application file. He stated that <br /> the proposed subdivision will continue to overburden the existing <br /> sewage treatment plant. He said that there was an agreement for <br /> expanded use of CSA-15 which has not been fulfilled and he strongly <br /> objected to use of CSA-15 for new lots, when the agreed upon use <br /> has not been met. He said that there are odor problems from the <br /> effluent from the plant. In answer to a question, he said that the <br /> subject property is within the CSA-15 boundary. <br /> -3- <br />
