Analysis -_ <br /> Background <br /> In June of 1999, the applicant submitted Use Permit Application No. UP-99-0014 for a regional church <br /> facility that consisted of a fellowship hall with 975 seats, a K-12 private school, a women's shelter, staff <br /> housing, a maintenance building, and athletic fields. The request for the women's shelter was removed <br /> before the item appeared before the Planning Commission. In October of 1999, the Planning Commission <br /> denied the Use Permit Application based on the inability to make finding No. 5 in the affirmative. Finding <br /> No. 5 states: 'The use is compatible with adjoining land uses." On appeal, in December of 1999, the San <br /> Joaquin County Board of Supervisors omitted the proposed day school and approved the Use Permit for <br /> a regional religious assembly facility to be built in three phases over eight years. <br /> On May 22, 2007, the Board of Supervisors approved a Revisions of Approved Actions for UP-99-0014 to <br /> change the phasing from eight years to sixteen years. Two of the six buildings approved as part of the Use <br /> Permit have been constructed. A third building is nearing completion. The third building will be for Sunday <br /> school services and for the day school, if approved. <br /> Neighborhood Comments <br /> There was a Revisions of Approved Actions application proposed to change the phasing of the church from <br /> eight years to sixteen years and to add a K-8 school. The Community Development Department received <br /> four letters of support for a K-8 school on the church site as part of that application. The letters stated that a <br /> private school outside of an urban area would be an asset to the community. During the review process for <br /> Pie Revisions of Approved Actions application, the Community Development Department informed the <br /> applicant that the addition of a new school would require a new Site Approval application. <br /> One letter was received in opposition to the proposed school. The letter stated "the Board of Supervisors <br /> denied the school aspect of The Home Church when The Home Church was originally approved. The Board <br /> had several concerns, but the fact that the school would be in an agricultural zone was a major issue. <br /> Nothing has changed to warrant approval." <br /> Prior to approving an application for a Site Approval, the Review Authority must make five findings in the <br /> affirmative. Finding No. 5 still cannot be made in the affirmative <br /> A K-12 school was originally part of Use Permit application No. UP-99-0014. The Planning Commission <br /> denied the permit based on the suability to make Finding No. 5 On appeal, the Board of Supervisors <br /> omitted the school and approved the church because they also could not make Finding No. 5 with the <br /> inclusion of the school large numbers of children present seven days a week is not compatible with the <br /> surrounding agricultural land uses. The surrounding uses have not changed since the project was originally <br /> approved.
