r
RECEIVED
December 9, 2004 DEC j 0 P004
Community Development Dept.
San Joaquin County Planning Commission
Kerry Sullivan, Director
San Joaquin County
Community Development Department
RE: USE PERMIT NO. PA-0400268
PUBLIC COMMENTS
I am submitting comments regarding the use of said property within an
agricultural zone area. It is becoming even more increasingly difficult to
continue to farm due to these types of uses being allowed and other non
agricultural uses within an agricultural zone. With the increasing regulation on
pesticides, dust controls etc. the "Right to Farm" has become very limiting or a
pure "JOKE'. Also with the increase in speculation of a "Green Belt" within this
area has also limited the values of property for generations to come. We have
been farming this area for over the past 50 plus years and have continue to work
with the challenges that have been place on to the agricultural community, but by
allowing non-agricultural uses adjoining agriculture and within a agricultural areas
have increase the lack of concern of the County. Therefore again, making
farming almost economically impossible to continue. Another concern is the
mitigation of traffic concerns and how it will be handled at the site as well as on
Armstrong Road. The other immediate concern is the access to the site and as
it exists to the current location. Again I have been farming in this area and have
seen the ever growing changes and safety concern. As the site exist and the
fencing that is placed on the site, the current access is a problem to happen.
Vehicles enter and exit this site within a very short distance to the signalized
intersection of West Lane and Armstrong Road and on numerous occasions I
have seen vehicles and experienced vehicles backed up into the intersection
creating a conflict with the demands of the signalized intersection. With the high
rates of speeds within the area this could only compound the safety concerns.
Also the sight distance that the type of fencing that was recently constructed,
allows very limited and restrictive constraints for those vehicles entering and
exiting. Other issues would be the increased in traffic on Armstrong Road and
the intersection of Armstrong Road and Micke Grove Road. This intersection is
already a safety concern with accidents, increased property damage and the total
disregard of the traffic controls that exist. Again with the ever increase of uses in
the area, traffic and safety has become an issue for the farming operations and
the disregard of the rights of the farming community.
These are just a number of concerns that I am expressing regarding non-
agricultural uses within an agricultural zone. The County as well as the City
